ILR eligibility

Thank you very much for your post, kindly find below, all the events in chronological order and advise

Tier 1 General Visa application submitted in UAE :13/7/10
Visa approved : 28/7/10
Entered in UK: : 14/10/10
exit UK : 23/10/10
Entered in with family :16/6/11
Exit UK(No stamp on PP as i was having UAE e Gate Card)
Entered in UK again : 25/8/11
Entered in UK again : 02/02/12
Entered in UK again : 01/5/12
Entered in UK again : 01/6/12
EXIT UK (ENTRY STAMP IN DUBAI : 11/11/12
Entered in UK again : 15/11/12
EXIT UK: 09/4/13
Entered in UK again : 25/4/13

During that time ( Oct 10 - June 11) applied almost 100 places no job was offered, Islamic Bank of Britain interviewed over phone and called for interview wanted to hire but as my visa was left at that time was less than 2 years they refused (against their HR policy).

After trying for job i have set up Ltd.Company in 05/7/2011.
all the accounts are update and tax paid.
company's main work is to buy houses, refurbish them and sell or let them.
since then invested in UK economy approximately £300,000. from overseas investment in the UK. our companies tried to help local council to buy run down boarded houses and made them good for living. got lot of training in this field in the UK.

Visa Extension approved : 31 Oct.12 till 31 Oct.15.

income showed at extension also income from salary from Dubai.
as there was less income from UK, I continued job in Dubai as well and used most of my paid or unpaid leave balance of 5 years ( to come to UK for longer period to start my business here ) and showed salary of bank job in Dubai from June till Dec 2011.

I was under treatment as well at that in UAE, some of the test copies sent earlier, and when I came here, NHS also did some test as post procedure

It will be helpful if you list your absences from UK in the " From - To - No. of Days - Reason for absence" format, rather than penning down just the dates leaving others to calculate the number of days for you.

And what's the question about in that long post?

I have very difficult case, having out of uk for about 240 continuous days in 12 months period ( which can't be split into 2 years) due to some medical reasons any advice will highly appreciated .

Ah finally! We have the figure that you were expecting others to calculate for you.

Read 245AAA(c) and 245CD-SD to understand what the immigration rules state with respect to absences from the UK.

If the caseworker doesn't bother checking whether you meet 245AAA(c) and 245CD-SD, you'll be fine!!
But what if he does check? Here's a recent case posted.

So, prepare documentary evidence(s) to convince the worker that you satisfy the requirements.

Thank you very much for you help.
I am trying to but, as i have my own ltd company set in UK, as was travelling out of uk. but my first 245 days exit is very crucial.
I was having some health issue as well and my wife was under treatment as well. if you could advise, which fact i should give all or only only health issue of me and my wife ? or all different for different time period?

You should present all the relevant facts, with documentary evidences, and hope that the caseworker uses his discretion. The onus is on you to prove that you meet the requirements!

e.g. -
How "serious" were the health issues? Why couldn't you have undergone treatment in the UK? Do you have evidence to show that there was medical advice that you shouldn't travel / return back to UK while under treatment?

Prepare for the worst (caseworker will question your absences), and hope for the best (he won't bother checking for evidences with regards to your absences).

Thank you for your time, I have 2 evidences/reasons explained as below ....should produce both ?

1- my treatment - continuous weekly injection course of 6 months and that was for HCV- even when i came here follow up blood test/endoscopy / scanning was done and still as a procedure need to be done every 6 months.

2- my wife's treatment as she has also gone through Miscarriages etc and IVF treatment. which cannot be stopped.

Her Treatment started in 2010 and finished in March 2011
my illness was there since 2009 but treatment started in 2011-2012 - but i could manged to travel for 2 weeks to land in UK within 90 days.

shall I submit the NHS early reports as well along with overseas to support the evidences for the illness.
if some had case like this i really appreciate guide lines.
even i am trying to hire a consultant as well but who has an experience of cases like this.
