Apply for a Tier 2 visa from outside home country

Post by Ln1124 » Tue Jul 28, 2015 7:20 pm

Hi guys,

I am currently residing in the US under student visa (F1) and not US citizen. I'm from an Asian country. I'd like to ask if I need to go back to my home country to apply for the Tier 2 (general) visa or I can still apply for it from the US. I have been looking around but could not find any.

Any documents or comments would be very appreciated.

Thank you guys!!!

You can apply from US itself since you have a valid leave to remain in the current country of residence (US).

I just found out that my situation is more complicated than it should be: my U.S. visa already expired, I just have a document (I-20) stating that I am a student from a U.S. School and that the program's length is about 2 years starting August 2015. I am wondering if that paper should be enough to prove to the UK embassy in the U.S. that I am staying here legally for at least another 6 months and can be granted a U.K visa from here or do I have to go back to My home country and apply for a UK visa from there?

How can you be legal if your visa has expired?

It's a little different in the U.S. Depending on your country of citizenship, they grant us different length for the visa. In my case, I have only one year student visa. I'm still staying here legally as long as I'm still going to school. If I drop school, I have to leave right away. Or if I leave the country and want to come back, I have to apply again. They will again grant me another one year visa only, even if the program is a 5 year one.

AIUI, UK Visas and Immigration won't accept that you have legal status in US based on your I-20. What they'll need to see is a valid "residence permit" (visa).

If in doubt, check with the UK Visas and Immigration in the USA.

Tier 2 General Application - original certificate of award

Post by Ln1124 » Tue Aug 25, 2015 12:12 am

Hi,

I read that the government requires to submit an original certificate of award. I am not quite sure what it means. Does it mean I have to send them my original diploma? If not, what is the document I have to submit? I graduated more than a year ago, so I guess An official transcript will not suffice. I graduated from a college in the U.S., so I am not familiar with the UK system.

Thank you!

Have you made an effort to read the Tier 2 policy guidance?
Read clause 17.

Hi,

I am currently in a similar situation but I have been living in Sweden Since Sep 2015. My my residence permit has ended in Dec 2017 and have applied for extension but my application is pending.
So we did you do? did you apply from US or India?

Thanks in advance
