Probably best to wait, its frustrating but its like that, i had the same,after submitting papers on 15.07.15 had no COA. I've tried emailing twice calling on phone few times but didnt change anything, it just multiplies your frustration.especially you read on this forum somebody got it in a week others in two, someone even in few days. mine arrived in two months, dated 15.09.15.

For your questions 1-4, I would recommend you google, research and make sure you understand very well what it means to be a "qualified person" as this will be the most important key for your application's success or failure.

I believe they are all made on the same card but they put different info in "Type of Card" and "Remarks" at the bottom depending on your immigration status and visa.

I am not sure I have ever posted here, but was following the thread and wanted to post my timeline. I am a French national. My wife (Chinese) applied for a residence card (EEA FM) on April 1st. She got Right to Work letter mid April (forgot the exact date). Today she has just received her passport back with the residence card stamped on it. :)

Thanks, feifei, for letting us know. It's crazy how the Home Office delays issuing RC's until just a couple of days before the expiration of 6 months in some cases. Have you contacted them recently or just waited until now?

Is there anyone who's been waiting for more than 6 months?

I know Declaud posted that his application is over 6 months, is there anyone else? I strongly believe that you should write, email, phone, submit a FOI request on whatdotheyknow.com, contact Solvit and do everything else possible to make them respond once your application reaches 6 months. Otherwise, if you stay quiet, they won't feel any pressure, because apparently the law alone doesn't concern them very much.

You should understand that once it's over 6 months, they can't call you for an interview, send you any more "questionnaires", come for home visits or do anything else -- those opportunities are gone for them so they must issue your RC or give a valid reason not to, and if they haven't refused your application by the end of 6 months, they most likely don't have any valid reasons to do so, so the only option for them is to give you your RC. So don't be afraid to demand it.

nope, haven't contacted them. We were patiently waiting! My wife actually submitted her passport and all supporting documents at the time of application (she took the chance to live without passport for 6 months). So absolutely no news for almost 6 months, and then today, the holy mail arrived ;-)

1. she must stay and be "a qualified person" (which means: working, being self-employed, or studying or having enough money in savings-self sufficient) for the whole application process (which takes up to six months) because HO sometimes calls the EEA employer and makes other checks.

2. you can travel in and out of UK until your EEA family permit expires, afterwards, it will be complicated to re-enter UK.

3. what do you mean? if your wife works, you don't need a private health insurance, if she is a student, self-employed, self-sufficient - you need to buy a private health insurance. there are different prices, depending on company.

4. yes, it is a problem. if she is not working, not being self-employed, not studying, not being self-sufficient, your EEA residency will get refused.

There's a small possibility that they will refuse even after 1 year. However, what I was trying to say is that you are not helping yourself in any way by waiting longer than 6 months and by not contacting them hoping for a good outcome for being patient. All the investigations and verifications must be done in the first 6 months. After that, it's just a waste of time. Wouldn't you rather get a refusal sooner than later?

I didn't want to provide actual answers to mayakanon's questions because it's hard to cover such an extended set of topics in a short post here. So, instead, I directed mayakanon to search online and do other research by him/herself.

For example, question 4 could be correctly answered as: Yes, in some cases it's OK if she is not working but only if she claims to be a job-seeker, which is also a qualified person. But you will need to provide proof that she is actively looking for a job (goes to interviews, sends out resumes, etc.). Also, self-employed persons do NOT need to have comprehensive health insurance.

I advise to read other, more detailed descriptions of what's required and what's necessary from other sources. The EEA FM application alone will answer a lot of your questions, not just question 5.

The EU citizen cab also be a qualified person if he/she is a jobseeker with genuine chance of landing a job like educational qualifications, job experience, lined up job invitations/interviews as proof. Although some say its not a strong claim so better wait until they land a job and just apply though "worker".

I applied my EEA2 december 2014 married
Coa received very next week
After 8 month iv received interview call which is i done interview yesterday in liverpool.
I did expect the same that its been over 6 month i would receive only a rc now . But i was wrong.

Hi..i got a letter from liverpool on 4th september..my solicitor replied them for our attendance but 22nd september he got another letter from home office that your client was failed to confirmed his attendance for interview, so therefore we are giving him a new date..my solicitor once again confirmed them by email..i also personally send them email as well as i send them a recorded delivery today..my question is that how we will know that they received our attendance.

Second someone told me that according to them i was failed to confirmed them of my attendance of first letter..may be they refuse me or detain me..is it true..infact we informed them already.

I applied my EEA2 december 2014 married
Coa received very next week
After 8 month iv received interview call which is i done interview yesterday in liverpool.
I did expect the same that its been over 6 month i would receive only a rc now . But i was wrong.[/quote]

When I said they "can't" call you for an interview after 6 months I meant they "aren't allowed to" by law. But, of course, they don't always bother with the law. My main point was that as soon as your 6 months are up you should raise a lot of noise and stink and demand your RC or a valid reason for a refusal. Now, if they haven't refused your application in 6 months, most likely they don't have a good reason to do so. An interview always gives them plenty of ridiculous reasons to refuse your application -- you said you prefer tea on a cloudy day and she said you prefer coffee when the sun is not too bright -- and now you are screwed, refused! That's why it would've been much better if you started demanding your card once your 6 months was up. In that case, the conversation should've been about the fact that they made you wait, didn't call you for an interview during all that time, now give me my card! In that context, it would've been a lot harder for them to play games and say, oh right, come for an interview at 9-10 months we want to ask you some questions. You should've insisted that they had 6 months to do so, which is plenty and which is what the law requires, now it's too late.

The reason most of us are here in this forum is to share experiences and get more detailed information about the application process in addition to the official HO publications and application forms. So I shared a simplified answers from my knowledge. As for the question 4 - it is really unlikely that a non EU spouse of someone who's only reason to move to UK is to be "job seeker" is going to be granted a residence card. And this is what mayakanon asked about.

For your questions 1-4, I would recommend you google, research and make sure you understand very well what it means to be a "qualified person" as this will be the most important key for your application's success or failure.

I didn't want to provide actual answers to mayakanon's questions because it's hard to cover such an extended set of topics in a short post here. So, instead, I directed mayakanon to search online and do other research by him/herself.

For example, question 4 could be correctly answered as: Yes, in some cases it's OK if she is not working but only if she claims to be a job-seeker, which is also a qualified person. But you will need to provide proof that she is actively looking for a job (goes to interviews, sends out resumes, etc.). Also, self-employed persons do NOT need to have comprehensive health insurance.

I advise to read other, more detailed descriptions of what's required and what's necessary from other sources. The EEA FM application alone will answer a lot of your questions, not just question 5.[/quote]

Firstly, let us know why you have waited so long? You have the right to demand an answer (positive or negative) from HO within 6 months!

Secondly, no, requesting a new COA will not affect your application.

Why you haven't received a COA? maybe your solicitor did receive it and did not bother to tell you? As you see, solicitors are useless.

You should request your COA to confirm your right to work. You can do it via email nweurocoarequests@homeoffice.gsi.gov.uk stating your name, date of birth, case ID, address, sponsor's name.

You should have the right to work if you are married to an EU citizen. Your employer can check it in the employee checking service.

Yes, mmalinconia, you are right in some respect. However, if the EEA spouse of a non-EEA doesn't already have a job, he may start looking and going to interviews which will immediately make him a "qualified person" and thus eligible to submit an application for his non-EEA spouse. Depending on circumstances and the person, job search may take some time, up to several months. All this time may be saved by applying as a job-seeker rather then waiting until he actually gets a job and then applying as a worker. Once he finds a job, he can send an update to the Home Office.

To clarify, I agree that in practice it's better to apply after you've found a job, especially if you are looking for an easy-to-find, below £10 per hour job.
