So I get a letter from DX today saying that they have try to deliver my card but not successful my building is new and even google can't find my address on map so I call them to call me tomorrow when the delivery man finally come hopefully i can get it tomorrow :D

in first section its about
evidence relating to your marriage,why they used the word proxy marriage,
proxy marriage means that if some one is not present at wedding ceremony,
we was both present,please explain it,
and am sending them some pics and payslips of my wife and bank statements,and some bills,
council tax paper,some cards from friends,
please advice me some thing else of u think,
i already send them marriage certificate,payslips and bank statements of my wife,and some bill on my name,
some pics of wedding day,and some pics after wedding.letter from my wife employer ,

Hi to all those waiting patiently. Thought I'd post my stats here. For those with knowledge can I expect my husband's (Eu citizen) passport to be sent back soon, or should I ask for it back? Application was received on 14 September.

Yes, I did. I'm sorry to hear that! You do need to contact them to get a new one, ASAP, quoting your case ID No. (which will very likely be your husband/partner's case ID No.+1, if they have also applied for a card). Did you manage to find the email address? If not, simply write a cover letter and send it to the same postal address as the one you sent your application, again, quoting your Case ID.

Hi Kamoe,
I called them more than 3 times once I didn't receive my biometrics letter after 2 weeks of application. HO told me wait till 5/6 weeks later then call back. Yesterday was almost end of 6 weeks and I called them again. They told me to call back after 8 weeks. I was a bit pissed and asked why previously all told me is 5/6 weeks then now is 8 weeks? Then, HO only give me an email address to email them. I am really upset. Is it something goes wrong with my application. Normally, they will take how long to reply me?

Hi mard2530, Thanks! I'm over the moon.

No interview, no visit, no questionnaire.

I must have drowned them in evidence of our relationship. In addition to the usual requirements, we included personal statements from both me and my partner (his was 1,000 words long, mine about 2,000 words), photos of us both with known landmarks in the background and others with family and friends (I captioned them all with who, when, where on the back), birthday/christmas cards to each other, birthday/christmas cards from family/friends addressed to us both...

We haven't even received the documents back. My lawyer reckons that the documents package is so massive that it's taking longer to be returned than the residence card. haha

Any more good news from april applicants?
Hi all the April applicants, especially those who are waiting to hear from the home office like me.
I had all the documents back (including my husband's passport) from the home office today with the letter (dated 25 Sep) saying that I should receive my card (RC) within 10 working days! :D

I moved to a new place in the middle of July and have not informed of the change of the address to the home office. The landlord is still looking after my mails and this way I was able to receive the package from the home office that was delivered to the previous address today.

Here, I have one question...there is a note in the letter I received today saying, "on delivery of new card, the courier will require proof of identity and a signature to confirm receipt of the package."
I am a little concerned about what will happen when the courier comes to the house I used to live. Nobody can receive my RC on my behalf. I will tell the landlord to ask other tenants not to mention to the post man that I moved out. Will he still leave a notice paper for me? Does anyone has a similar experience like me? :?
I am still waiting for my RC....has not arrived yet...the letter is dated on 25th Sep 2015. :roll:
Within 10 working days from the date shown in the letter, it will be soon reaching the deadline.
If I do not receive it this week, I will send an email to the Home Office as their email address is provided in the letter. Has all the April and May applicants who received the RC letter (documents returned) have received your RC?

They use the proxy marriage in case you did it, but dondt worry everone how is receiving a questionnaire receive the same questions and the same paper. But You have to be careful and answer all the question and explain everything. Explain that it was not proxy, we both was in the cermony and show pictures.A friend of my husband he received a questionnaire and got his RC after one week, so dondt think that all is getting refused. We have been unlucky buts its not mean everone will get refused after qustionnarie. Send your marriage certificate agian if you have orginal one and picture and bills. Remember to take copy of everything we will send the Home Office and the questionnaire. I wich you good luck, and I hope we will hear good news from you soon. If you need anything else just write to me.

You should ask for your passports return.

I asked for my passport (with EEA family permit) return in early July because we had a holiday planned traveling to France in late July and I needed my passport. To be honest, I truely expected that my RC would arrive before that. No hope...did ask for my passport return in the last minute. I did not know this forum. I wish I knew so that I could have more information and estimate my timeline. My husband is French and he applied for his French ID card before I applied for my Residence Card knowing that his passport had to be sumbitted to the Home Office. As he can travel within EU with his French ID, I did not ask for his passport return at the same time I did.

Anyway, there is a page on the website to request for return of documents.

I did not write any reason and just asked for my passport return and it was straightforward.
But the only thing is that there was no email confirmation as such that I requested online.
So, I had been uneasy until I received it (in case that the requrest did not go through, my passport got lost, etc.). It arrived rather a lot earlier than 10 working days.
The enclosed letter says, "Please do not return your Passport to the Home Office until it has been requested by a caseworker. I was waiting to be told to return my passport, but it did not happen. :o
Supposing that now a RC card is a separate biometric card and it used to be on the passport.
Perhaps, they just used an old template of the letter.
Later I thought that I should have asked for my husband's passport return at the same time I did.
I did not think obtaining RC would take such a long time. My husband's passport evetually came back with the documents and letter informing that I should receive my RC within 10 working days (still waiting though).

I think it's clear by now that the Home Office never sends any type of email confirmations. At least you shouldn't expect any, no matter what you do.

With reference to your earlier post, I think previous immigration history may have affected your husband's application. It is on the basis of the information you provided that I ask: What was the outcome of the initial asylum application?
I understand that HO withhold passports when an application is denied/refused. If this was the case, did your husband appeal that decision?

It was refusal on asylum application, and my husband did not appeal . I will try to request his passport again, im not sure if they will return his passport because they give him refusal on asylum

Hi nora, I honestly think you should seek professional advice because this case is a bit complicated. I know you have made a decision to appeal but you need to evaluate your basis for appeal. Your husband failed to present a valid passport because the previous one was withheld by HO following a failed asylum application. Am of the view that your husband's failure to appeal 3 years ago might have had an impact on the RC application. Please seek legal advice from your local Citizen Advice Bureau or a reputable immigration firm if you can afford it. I wish you the very best :)

By now you should be aware that calling the HO usually solves very little. If they have finally given you an email address, then that's progress, as from what people have posted, everything that has worked is through online forms and email requests. Never by phone.

Would that address be the same as the one posted earlier about how to ask for a new biometrics letter, when the one sent is incorrect? Because apparently that one has worked, but not sure is the one you need to use.

Hope it all resolves for you. Keep us posted.

Do write to them with your full name, nationality and date of birth, plus the Case ID of your husband. That should do it.

Putin, I don't think you read my comment right. That's exactly what I was implying - that he can withdraw and reapply. Also, he can't "Apply new Application" without first withdrawing his first one.

I'm Colombian as well, although I applied as EFM as I am unmarried. I received the same letter, except they only cite the first reason in mine: That I did not submit evidence of relationship.

I think the standard procedure is to send that letter to unmarried couples, as no marriage certificates can be sent, but in your case, maybe, because you just sent a copy, they treat you as if you have not sent anything. It fits, as they also say you have not send evidence that your husband is exercising treaty rights (you only said copies of his payslips). We did send the original payslips of my partner, and I did not get that reason (lack of evidence of treaty rights) listed in my letter.

My advise? Yes, do send originals ASAP, to the same address you sent your application, include your case ID, and ask for a new COA, with right to work. And see what happens?

Hi Lali (and everyone else dealing with slightly complicated cases):

Knowing that most of us only speak from experience, not from a professional perspective, do take our advice as informal input. We are not solicitors nor do we work at the HO, so it might be worth it seeking advise from a reputable immigration agency before taking any significant action.

Now, in my humble opinion: I think my first advice might not have ben the best (hence my rant above). I think you should not send documents separately, as they might get lost. It is better if everything is on the same envelope from the beginning.

As others have said, I think it is actually best for you to withdraw your application. I recently read someone else's post about how the HO guidelines to issue CoAs state that if the reason they did not give you a CoA with right to work is because you did not send all required evidence, they will not to send you another CoA with right to work when you send additional documents (see page 28 here: https://www.gov.uk/government/uploads/s ... s_v2_0.pdf):

Anyone issued with a ‘short’ COA due to their failure to submit the required evidence
cannot later be issued with a ‘long’ COA if they submit this evidence.


So if you want a long CoA, your only way seems to withdraw your application and apply again, correctly. Whether you will then be an overstayer or not... that is a question to ask a solicitor. I could not tell. But I would not be too worried about that, as you can always honestly justify the overstay given the case (there is room for that in the form, if you need to).

Lali won't be an overstayer because she is married to an EEA national. That alone gives her the right to live and work in the UK (even through it's hard to convince employers of that without an RC). Residence cards are NOT mandatory and they do NOT grant the right to live and work, they only CONFIRM those rights. So, if she goes a month without a visa, that shouldn't be a problem.

If anyone wants to hire a solicitor, the best way to go about it is to read up a few actual cases on this forum with a known outcome and then ask a prospective solicitor if he knows how things should've turned out in those cases. Most solicitors won't know it and will give you a flowery, non-specific answers. I tried that and realised that they don't actually know anything. They act like psychics mostly - ask you questions and then feed you back your own answers and that makes them appear to be clairvoyant.

U still can apply without withdrawal, bcoz later they can blame for being overstayers even though they gives u few days to leave the Country,so better apply first

I read someone wrote about proxy marriage, proxy marriage column is not mandatory for everyone., secondly check properly HO did not tick that section for everyone.
