Help Needed Please

Post by saj85 » Fri Oct 30, 2015 11:00 am

Hi Everyone

I am on stamp4 eu fam currently,i got married in 2007,got my stamp 4 for 5 years and it expired in 2012,from 2012 to march 2015 i didn't have any stamps on my passport,i stayed in the country during that period but i didn't have the stamp on my passport.
My query is,if i am eligible to apply for naturalisation as i have spend more than 5 years in the state on stamp4?or i should wait because there is a gap in my visas?

please help,if i should go ahead and send my application or i should wait any longer?

thanks

Why did you not apply for Permanent Residence, 6 months before your citizenship expires. Was your spouse working all throug?

As you visa has expired, you will have difficulty with citizenship.

What was the situation between 2007 to 2012, was your sponsor exercising treaty rights during this period.

What was the situation between 2012 to 2015, why did you not apply for PR .

If she did not work from 2007-2012, when you held residency, then you will not qualify, and more so the lack of any lawful status from 2012 , that is if she had not worked between 2007-2012, undermines your case.

But she was not living in Ireland or working during that period , was she? So you had no right to live here during her absence.

but thats not an issue, because i already applied for my visa this year and i recieved my 5 year stamp, and they never asked me anything regarding that peroid. So i feel this is not the issue. My question is different,if i can apply for citizenship now or do i have to wait for a year before i can send my application,as i have to be in the country for atleast a year before my 5 years time is completed,as i was always in the country but i didnt have the visa at that time, makes me think if i should wait or send my application this year.

Thanks for replying though.really appreciate

Well in law, it is an issue and your citizenship application will be refused.

You need to have continues permission to live in IRELAND with a Valid GNIB.

You GNIB expired in 2012, and you did not get a new one until 2015. Your lawful residence broke during that period.

They will nor ask you about the past period , when you applied for the 5 years on EU 1 , as it is not necessary.

If you had applied for 10 years, they would.
