Hi everyone,

I was wondering if someone here can help. I am an EU citizen, my husband is American. We have sent in his application in early October and he has sent in his Biometrics already. We are waiting on the COA. Some family matters have come up in the US and he needs to go back but when I was filling the forms to receive his passport back it said that by requesting the passport he acknowledges that if he travels with the document outside of the UK he may not be allowed back in. When I called the HO they told me to call the airport he will be coming through on his way back and ask border control, which is pretty impossible as border control is not easily contacted.

Have any of you traveled outside of the UK while waiting for your application to process? Will he not be allowed back to the UK?

In my personal opinion, legal assistance in this case is a bit excessive, unless Home Office ignores your calls and inquires. But I have never had any problems with that. So I would recommend call yourself.

omggg 11 month its really too long have call them yourself?dont trust your lawyer 100% or if not you need to be there when they make the call and how did you get second coa?the eea2 max time is 6 month![/quote]

My employer gave the email as the previous one had expired over a month. It was delivered within 2 days after application. I had asked my lawyer & he kept saying he hadn't got it in over 1.5 months so maybe they never asked for it so I'm paying them for nothing!

Good news..i have received my biometric residence card today..it was dated 31st october 2015. i have been through a hell for the past 5 months. i applied on 08/06/2015. the nightmare and the sleepless night is over now. i wish all applicants waiting for theie BRP the best of luck and to my fellow june applicants :D :D i am wishing all of you a successful month. billy s i am with you and God will see you through.

This is another part of the nightmare of the outrageous treatment dispensed to the EEA family members waiting for the residence card. There are not tenant's checks yet, except in the West Midlands. The tenant's right to rent will be verify from February 2016 by all landlords according to the xenophobic legislation of the actual government that is going to transform landlords in improvised immigration officers.

I am at the same situation. I suggest you to try to stay where you are, they can't ask you to leave the flat on the grounds of your EEA family member's lack of residence card. (In fact the residence card only confirms the previously acquired right but that is something they will not understand).

The Certificate of Application should be enough proof according to the same HO to allow you to rent a property, they will implement a telephone number where the landlords or letting agencies will be able to verify the tenant's right to rent, but from February 2016 as I've said before. They must not reject you because if would be "unlawful discrimination" when conducting right to rent check.

They alternatives you've got are

1) To write to the Home Office asking them if the CoA is enough for your couple to rent a flat, try to do so by normal mail so they can send you a formal letter (this is difficult because the answer will take time and possibly they won't answer). The letter will be your support in case of unlawful discrimination from letting agencies or landlords, because HO will explain that she's got the right to rent while she's awaiting the residence card.
2) Send an email to HO public enquiry, (will take 20 days to answer and sometimes they won't answer), the email will explain the validity of the CoA in order to rent property.
3) Tell the prospective landlord or letting agency to request a right to rent check through the eform from the HO:

HO will answer with a yes or no about the right to rent. Using the Case ID or Reference Number would be enough to verify the CoA and to state that she can or not rent.

Yes, we can stay in our current proprety at the moment, but what if we get an eviction notice before February 2016? The law is completly unreasonable, and we will be unable to do anything without passport and right to rent.
We called the HO and they sent us a copy of the Certificate of Aplication but all the estate angencies refuse to rent us a place without her Residence Card. The Certificate of Application is not a valid document for them.
We also called Shelter.org.uk (an helpline) which helped us to understand what was going on. They confirmed that unfortunately we have no right to rent since my partner has no valid documents.
In conclusion for the british law if you are non EU partner of EU citizen, waiting for the Residence card you can't leave, but you can stay, but you can't rent anything (for 6 months).
Is that makes any sense?

I have one question my wife got job now I got letter from company and her name is registered with HMRc now. should I wait for pay slips as it will come in the end of this month or I can apply with the business job letter which shows that my wife is on job now. please do advice me waiting for your quick reply,

But have you applied for a Family Permit before the Residence Card or is this your first application?

I'm asking because we had to prove our relationship/marriage when we applied for the Family Permit, still in our home country. An agent called my husband (he's non-EEA) and asked some questions about us.
Maybe that's why we have not received any questionnaire so far... But let's see. We'll relax only when the RC arrives!

Hello Faisal ,
if you have a look at the application form for EEA FM you will notice that they ask for the last 3 months payslips... so what we did was wait until we had 3 months payslips before sending the application.

No this is my first Application. Actually the evidence they asked for is already with them.
That's weird. If they already know/have everything, why do they have to complicate?
Anyway... let's hope for the best.

I am literally in the same situation, my American husband and I (EEA) are going to a wedding and spending thanks giving with his family in New Jersey. Although we go back there every year, his wait for RC has about 1 more month left, and his student visa of 6 years ended 5 days ago, so he is in limbo with travel at the moment. However we looked at other stories of this and a lot of people said they just took every possible evidence documents, proof of application, of living in the UK, marriage certificates etc etc, and when they went up to passport control, they handed over all the documents and explained their situation and they were ok.
Gonna take our chances!

Good Morning all , i send application for my wife on 04/06 i'm EEA national and also British National married with 2 kids with he both kids also British National , when i send he visa i was recently naturalized and did't have applied for passport as i was waiting for my kids application come back with my Naturalization certificate ,also i did't requested my and hes passport back yet
