Application acknowledgement and biometric letter: 11/09/15
Biometrics enrolled at PO: 29/09/15 (yes, bit of a delay on my part)
BRP received through DX Courier: 02/11/15
Approval letter/passport/docs: still awaiting

I was here in a student visa and got married to a dual Irish/Britich citizen last year my school was revoked and i got a letter saying that I have to leave before 18 of December 2015
unfortunately my wife cannot meet the 18600 requirement for spouse visa and we cannot go abroad to an eu country for surrinder (singh route ) and I am planning to apply for discretionary leave to remain
do i need any financial requirement and what evidence should a give please

I applied my wife FLR (M) on 5th of september and she did her Biomatrics after 3 weeks. Last week we recieved a refusal and it mentions that (1) you applied on Human rights thats why we refused it (2) no bank statment and employer letter although we provided payslips and pay60 (3) IELTS certificate is expired, and is not acceptable.

I have spoken to Solicitor and he advised me to make a fresh case and then apply for it and also do the new english test .

My questions is the payment we made for IHS £500 , can we use a same reference number of that payment in our new application or shall we wait for that amount to be refund first.

just want to ask you a question. what basis did you apply for Human Right

were you not meeting the income criteria? or any other basis?

this is the funny thing... They said that my mrs applied on Human rights basis on 15th august 2015 which is wrong.

my mrs applied on FLR M on 5th september.

this was a crazy refusal from them

might be human error.

did they give you right of appeal?

if so you can go for appeal then.

and if you want to apply as a fresh application then you can use the old IHS number I guess but not sure

Solicitor advised me to go for a same day application... because if we go for an appeal it might take weeks or months...

but i am not sure about IHS charges now .....is any one had an experience ?

if you go for Premium service you won't get the decision same day because your passport is already retained by Home Office. in premium service they only decide applications which are straight forward.

We received all documents back from Home office including passport and BRP.

because my mrs current visa is valid until 20th of February 2016 as a dependant tier 1 partner.

in this case premium service should be ok for you.

Could someone please help me.

I recently married a women I have spent the last year studying with. We are both based in London. She is on a student visa that expires at the end of Jan 2016. I am a South African citizen who has permanent residence ( ILR). I was granted ILR a year ago and I gained it after spending 5 years in the UK on a Tier 2 work permit.

I have the following questions, please could you help if you know the answers. We are pretty tight on cash and cant afford a lawyer.

- Will the fact that I gained permanent residence through a work visa have a bearing on the application process? I have read online that the process if different in comparison to say someone with UK citizenship who was born here and is applying for a visa for his or her spouse... If it is is different please could ypu explain the difference rather than posting a link as I am a bit confused.

- Will we both have to have a certain amount of money in our accounts for 3 months? If so, is there any way around this ? we have had almost nothing in our accounts for the last 3 months as we have been students and we want to apply now. We are both employed though and we both earn £35k per month, she is on a 3 month contract, which her work has agreed to make permanent once she gets the spousal visa, i have a permanent full time position. We cant wait for the 3 months because her visa will expire and then she will have to leave the UK, lose her job and then apply from outside the UK. We could both get employment letters from our respective companies detailing salary etc, both companies are household names.

- Will she be subject to the healthcare surcharge and does she have to pass the life in the UK test?

- If we opted for the same day service in Croydon, what from your experience would be the waiting time for an appointment ? I know they say up to 6 weeks, but I would like to hear from someone who has recent experience of the actual times rather than the "safe" period of time that is normally given.

Please could you let me know if you know the answers to any of the questions, any help would be very much appreciated.

I checked my bank statements against payslips today
And for september i was paid almost £100 pound
Less than i have on payslip. I have informed my company
About this. Ive spoken to people who've told me
That i need a letter from payroll explaining the error
And for the payment to be made into my account straight
Away. I've been told to also get a letter from the
Signatory of the letter confirming that he/she is a qualified
Accountant. And that lastly i need mention of this in my letter
Of employment which confirms employment.
Im worried about this as ive heard of people being refused
For errors that are in the pennies. Will this be sufficient
To satisfy a clearance officer. I dont think i could wait
4-5 months. Can anyone help with any explanatio
n or clarification. Thanks.

Raz i am not a solicitor nor an immigration lawyer so just giving you a personal opnion - Payslips are submitted through RTI so your payslip is already confirmed with HMRC. If you explain shortfall in a cover letter and add company's confirmation letter than i personally think it should be fine. But never ever try to send information that doesnt match without explaining it... Alternatively you may ask your company to re-process your payroll from net to gross to show net salary on the payslip exactly as it appears on your statements and ask them to adjust the actual shortfall of your pay in your next payrun - In that case you wouldnt have any problem.

your another option is to ask your company to pay you the rest of the money and you just need to explain that in a cover letter.

It is very common for companies to make such errors and they normally end up reprocessing the payroll, as long as the RTI is not submitted it shouldnt cause them any problem, in other cases HMRC do ask explaination but that rests with company ..

However please seek an expert solicitors advice as obviously the last thing you want is your case ruined due to poor advice before you action..

Biometric request letter dated 16th Oct received: 19/10/15
Biometrics submitted at PO: 23/10/15
BRP and docs: Waiting

Reason: PTE (English Certificate) is not relavent but it was still relavent untill 06/11/2015

And I havent got the right of appeal aswell because I was an overstayer.

So now what can I do because it is their mistake.
