Hello Geeks
I am going to apply for ILR in April 2016 Via TIER 1 (General) Route. I have got My 1st Tier 1 approved on 24 may 2011. ( Applied on 5th April 2011). I have got extension in may 2013. My partner came in UK feb 2015 after marriage.
i have many questions.
1. Maintenance Funds for both of US. ( HOw much ).
2. I have been Cautioned by police in october 2011, which I mentioned during my extension, Can this affect my ILR application ( Worst Case scenario).
3. I ve passed Life in Uk, Got Degree from UK University.
4. Which application form I need to apply for My partner, FLR-o or FLR-m.
5. Do I need to pay for medical fees for my partner.

1. No need maintenance for you, but your wife need £630 (at current rules) for 3 months in your/her account.

2. No problem, as it was 4-5 years ago.

3. So you get points for your qualification and language requirement, no worries here as well.

She can continue to extend her current visa on the PBS Dependent form (she does not have to switch to FLR(M) visa) or she can switch to FLR(M) once you have ILR and this will reset her ILR clock to zero and she will need a further 5 years (2 x 2.5 year visas)
5. Do I need to pay for medical fees for my partner. Yes, you will have to pay the immigration health surcharge for whichever route your wife applies.

You can apply for PBS (Tier 1, 2 & 5) Dependant form to extend your wife visa but it will be valid for 3 years and you said your wife got Tier 1 dependant visa in this Feb, means Present visa valid period + 3 years is less than 5 years (Your wife must stay for 5 years in order to qualify for ILR). So you may need another extension, in this case you better go for two FLR (M) extensions, because FLR (M) fee is £649 + £500(IHS) and PBS Dependant fee is £1736 + £600(IHS).

well My wife got her Tier 1 General Dependent visa on 4th july 2014.but she came in UK 24 feb 2015.
1. Do she need to pass IELTS to switch FLR(M) fro PBS dependent?
2. She got Master's Degree from Kurukshetra University. Does she needs to Change that to NARIC??
3. she is working in an MNc does she need to show her wages slips.??
4. Currently I am on Employment + Self employed. Very soon I am going to own a business in retail with partnership so I am thinking to stop my employment & Self employment. and going on Profit Share basis instead of wages. and I m thinking to aPPLY on 28 april 2016, currently my 12 month regular ( 12 month income from any 15 month before apply) is around 40k. if i stop my employment in December, what documents do i need to show UKBA.
will do they ask about my employment status??

1 & 2. For FLR(M), she need to show language requirement. As you said, she has Master degree from university, the UK NARIC certification not necessary but Medium of Instruction letter (i.e. letter saying course was done in English medium) from university is compulsory, if she got this no need IELTS either.

3. There is a necessity to show previous earnings for FLR(M), but it can be your earnings or your wife earnings.
As you said your wife working now, so she can show that earning but they must be £18600 or more for the previous year, if she is has earned less than that you can show your earning, that is not a problem.

3. There is no requirement to show your current status and they don't ask you what are you doing at the time of apply. They only look into the previous earning of consecutive 12 months earnings in the last 15 months period. I know the required documents for employed and self-employed but you said , your new business would be a profit based business, I can't understand that.
As you said you are thinking to apply on 28th April 2016 means your period to show the earnings must not fall before 29 January 2015, i.e. you can't claim points for the earnings before 29th Jan 15

my current business is a ltd company with partnership. with 50 % share holder. so instead of wages we will share profit, 50- 50.

Then you need to show the profit & loss statement certified by the accountant (CA).
Company incorporation certificate(all pages, I mean the directors and shareholders information and share value).
Business bank account statements.
And letter from the other director or partner of the business like NOC to access the funds.
Dividend vouchers,if you received any.

I just wanted to know, Can my partner submit LIFE IN UK test result instead of English requirement certificate, and NARIC.
Or its necessary to submit only NARIC or English certificate.

She needs Life in the UK Test AND she has to meet the English Level B1 Requirement with submitting proof. It is not an either/or choice.

I also want to know. I have passed my Masters from one of UK London based university. As it is not coming in Point based calculator any more. Do i also need to apply for UK-Naric.
Or I just need to present my degree during ILR.

Very urgently, I have booked appointment in 1st week of may, Just Some queries

1. I am going to apply for ILR, while my wife going to apply for FLR m
2. We both got appointment same day, Just 1 hour difference. I am applying 1 hour before,her.
3. currently I share house with land lords, i don't have any tenancy agreement as we are friends and know to each other from long time. I usually paid rent cash to them. So which kind of letter I need from the Owner, and , Because in ILR form they asked about the rent How much we Pay,???
4. Do we need to send a covering letter to tell them that all the docs of mine which she need are already with UKVI.

Please give me last minutes suggestions.

Hello Geeks, Urgent Urgent

I had UKVI appointment on ******** day.

I have following situation.
1. 5 year tier 1 general visa.
2. FLR(m) for Partner.
3. Employed and self employed.
4. Simple Caution in 2011.

docs submitted
1. Payslips, Bank statements, Invoices, Accountant letter, 5years Tax returns.


Queries.
I have received call from UKVI saying that their systems are crashed on 1 day before from my appointment. but I went their according to 1st booked appointment with their email and old payment references, to confirm and, they said that yes that was true, but their systems are back now and they can consider our applications.

They asked me For class 2 NI for past 5 years and 5 years HMRC history but I have 5 years Tax returns prints outs and 4 years Class 2 NI paid originals, which i have handed, But they Considered my application and decision is pending,

I have following situations,
1. Variable income during 5 years. some time under 35,
2.1st and extension got on more than 35K , taxes are paid and all.
3. Decision Pending for our Applications.

Whats going to be happen Now, What I need to take care of.

I believe when they consider your application, they take your finger prin but verification of biomatric was not going through because HO has the issue in IT department.

You don't need to be worry, they did not hold your application for further digging. The case worker has already gone through your case but they can not tell you the decision because of IT issue & bio matrics could not verified. They will phone you sooner to let you know to collect your papers or they will send your address. Do not panic it's not the holding case, it's just issue with their scanning department.

This issue is happening because of backlog for few days, since Tuesday due to IT issue. It will be back to normal sooner.
