Hi, I am regular visitor but recently registered

Application sent 19/06/15
Received 21/06/15
Biometric sent 29/06/15
COA received 03/07/15

I am still waiting for the outcome of my application

When I was issued RC in Jun-10 they had my DOB wrong, so my lawyer sent back and I got it corrected with RC end date changed to Dec15, but as my wife & kids still had their date as Jun-15, I applied in June to avoid any issues.... Btw my application is dependant of my mother who is EEA national. No issue of documents as everything was provided, can anyone suggest what would be the cause of delay?

Thanks in advance - I see people in here are very helpful...

I would like to share my timeline:

10 Aug - application sent
12 Aug - received by home office
17 Aug - biometrics done and sent to home office
20 Aug - wrong COA received
18 Sep - correct COA received
PR - still waiting..

Has anybody from August applicants received PR?

Hello Respected Gurus

I need an advise and hope someone could guide me as to whats best way to approach this situation.

I have been married now for 6 years however my relationship has now broken down and we now half way tru the divorce procedure however i have a RC which is due to expire in 2019 however i have been issued RC twice so i am qualified for indefinite or PR by virtue of RR so my question is what can i apply for as soon as the divorce is come through.

I believe i can simply go ahead to apply for PR directly or would i need to apply for RR before PR or could i apply for the both together?

I will appreciate any sort of advise.

Hi,
1. Were you married for at least 3 years?
2. Was you wife exercising treaty rights or have PR?
3. Can you support yourself/ are you on a stable job?

If yes too all of the qs, then you can apply for PR directly, when you complete 5 years since the date of your wedding.

If you are still months/ years to complete these 5 years, still you do not need to apply for ROR, others might suggest that, as its safe, but I was in same position and my solicitor said I don't need it, as I automatically qualify for ROR. I have crossed immigration thrice and carried all docs and had no problems entering UK. After completing 5 yrs, I have now applied for my PR Card.

hello everyone,
I am a non eea national,filling up my eea4 form for PR.i need help on some questions please.
1. I do not remember exact date when my fingerprints were taken in my home country with my EEA FP application,but i do remember the month and year.Can i write approx date?
2.They asked to write any HO ref no. and any documents ref: no.shall i write HO ref along with my FP and RC ref:?
3. date first entered:i first came to uk on tourist visa in NOV 2003.Then came back on EEA FP in sep2010.which date should i write?
4. country visiting date:Don't remember exact dates ..can i write approx?
5. EEA national activities and employment history:Do we have to provide since they entered in UK or just from last 5 years?

Hi Ally, I've applied as a non-EEA spouse of an EEA national (sent both passports but only for my PR) and received a COA dated 18th Nov. Nothing since.

Hello raclett, thanks for your reply. I just realised that my Eea national doesn't have PR but she lives and working since 2004,does she have to apply for PR first to get me PR? And form will be the same for EEA national.(EEA4).THANKS

Hi,
1. Were you married for at least 3 years?
2. Was you wife exercising treaty rights or have PR?
3. Can you support yourself/ are you on a stable job?

If yes too all of the qs, then you can apply for PR directly, when you complete 5 years since the date of your wedding.

If you are still months/ years to complete these 5 years, still you do not need to apply for ROR, others might suggest that, as its safe, but I was in same position and my solicitor said I don't need it, as I automatically qualify for ROR. "2. Was you wife exercising treaty rights or have PR?"

If my wife (who is EEA) gets her permanent residence during my 5 year RC. Then, we get divorced. Then, when I apply for my PR based on retained rights, do I need to show ONLY that at the time of divorce she was a permanent resident OR do I also need to show that she was exercising treaty rights before she got her PR?

Hi,
If she has PR at the time of Decree Absolute, then you don't need to show that she has been exercising treaty rights because she would have already done that when she applied for PR. Even in the form EEA (PR) they mention that if the sponsor has PR, then skip the rest of the Section of all those details.

But keep in mind that they ask for her PR card & passport when you apply for PR through EEA(PR). Most of the applicant cant get these docs after divorce, so they do accept certified copies of the docs. I did the same.

hello everyone,bit confused....my mrs EEA national living in uk since 2004 and working since.we got married in 2010.according to law i can apply for my PR now(5 years now).one of solicitor told me that my mrs have to apply for PR first for her self :shock: then i will be(non eea member) able to apply for PR?is that true?

I don't think it is correct. You have now obtained PR automatically after 5 yrs of being married and can apply for it individually.
However, you both apply together as well using the same form EEA(PR). She will have to prove that she's been exercising her treaty rights in the last 5 yrs.

Timeline:

01/07/2015 - Application received by Home Office (Turkish civil partner of an Irish citizen, who exercised treaty rights as both student and worker)
07/07/2015 - Biometric enrolment letter received
30/07/2015 - Certificate of Application Received

31/12/2015 - Literally 2 days after 6 months had passed since posting our application, I called the Home Office. Attempted to persuade me to call back at 'the end of next week, due to the busy new year period'. I persisted and the application was flagged for someone to call me back with details.

05/12/2016 - Received a phone call from HO. Was told nothing had been sent and that enquiries would be made. Could not give me any timeframe and said I probably wouldn't get a further call back. At this point I decided to raise with SOLVIT and local MP.

08/12/2016 - Received documents back with a letter stating that biometric card will be sent within 10 working days.

My advice? Once you're 1 day past the 6 month deadline, turn on the pressure.
