The EEA(PR) form replaces a bunch of the old forms such as EEA3, it's the one which should be used now

Thanks very much for your help. The above statement is news to me, I thought I needed to fill in the EEA PR form, not the EEA3???
You're correct. Use the EEA (PR) form:

Hello guys,

I am an EEA qualified person and married my non-EEA wife on March 2011. Her EEA2 Residence card will expire on July 2016 and she has to apply for PR now.

We've got a few doubts:

1. I read that we can apply before the 5y period in the thread, does that mean we could apply already (as I was understanding that the 5y period starts counting from our marriage date on March 2011)?

2. Do you know which documents we'll need to send? and as she's a non-EEA person, would we need to send her documents, mine, or both?

3. I was reading here that some people got a biometric letter after applying and then they sent their details. Do you know if we can send the details straight away on the 1st application?

4. I read that EEA(PR) form is not mandatory, ie, that a simple letter asking for the PR should be enough. Has anyone applied this way? And do you have a draft example to have a look?

5. By the way, the PR is a sticker in the passport for a non-EEA person?

Many thanks!!

Is there any October applicants hear anything from the HO yet? I also applied in October with my EEA partner and haven't hear anything back from them after I received the COA in November.
Any October Applicants should please come forward and share their timeline.

Ally007,

Was your application for PR on basis of unmarried Partners?? if yes,
Did you received COA with right to work?

Any unmarried partner received COA with confirmation of Right to work?

Thanks

Hi
Unmarried partner receives "short COA" which doesn't have right to work.
Ofcos you can never rule out human error which might make them issue a long COA.

That situation can easily be explained with a brief cover note (plus marriage certificate) to show the connection between the names.

Note wife will need to sort out her use of names (after naturalisation) before applying for first British passport.

That's not correct. I applied as an unmarried partner and my COA stated I had a right to work. Why would someone who has been allowed to undertake employment for the previous 5 years all of a sudden be denied this right?

Hello Learned People

I shall be grateful for your view on whether PR could be refused because the applicant was a jobseeker for eight and a half months between 2012 and 2013. I considered that there was a genuine prospect of work by virtue of being a degree holder but I am concerned that this might not be enough.

For only two months of the above period, EHIC was active as well as access to about 600 pounds of incoming personal funds per month, but the self-sufficient status was not elected for those two months on the application form. Would the caseworker rely on the activity elected on the form, or would they also consider any other 'qualified person' category available to the applicant?

Many thanks in advance.

As you don't mention biometrics I wonder if you are an EEA citizen yourself? I have the overall impression that for EEA citizens normally it doesn't take that long.

@thanks for correcting me jennmac, i didnt clarify enough.
@mi55tee on the premise you have previously had a residence card issued as an unmarried partner ie EEA2 and and now apply for EEA4 PR on that basis you should get the long COA.

Your work should not be affected as long you submit before the expiry date on the residence card, your employer can always do an ECS check with the home office which will confirm your continued right to work and give your employer statutory excuse of liability for 6 months.
Best wishes
