The article, you mentioned, indiciates that Immigration authorities are prohibited to ask parties questions about their sex life. I am not able to find that information in the EC handbook published in Sep 2014. Do you happen to know where that piece of information is located if it is there at all?

Home Office are really pathetic.

Nicosia v Papajorgji case reaffirmed.

Difficult to see how this equate with the Upper Tribunal flawed approach in Bilal, when the evidence the Home Office tends to put forward is nearly always flawed and incoherent.

Court of appeal finally puts to bed IS (Serbia), as it was bad law and must not be followed. Papajorgji is indeed good law, and the the court of appeal was right to endorse it in Agho.

For my sanity sake, I am happy the correct definition of marriage of convenience as interpreted in R (Baiai) v Secretary of State for the Home Department, has finally been resolved.

This deliberate confusion that the Secretary of State and the Tribunal always seeks to make, will have little or no basis in law from now on.
