Hello Friends,

I have a question

I am currently on Tier 2 ICT and my wife is on my Dependant visa. My wife is currently working for a UK based company. The employer of my wife is willing to sponsor her (if needed be) but they have not really done that in the past, so they are not entirely sure of the process.

a) Can some one please guide if my wife is eligible for switch?
b) What is the process that employer needs to follow? (They are a licensed organisation)
c) Once she moved to the new Visa, can she apply for Settlement?
d) If answer to c) is Yes, when can she apply for ILR? Does she needs to be on General visa for 5 years or will the time she had spent already as a dependent will be counted too?
e) What is the maximum duration of stay in Tier 2 general visa?

Also, I am currently on Tier 2 ICT. My visa started in Nov 2012. Am i eligible to apply for ILR if i stay in UK for 5 years?

Hi,
Since ur original ICT was granted after April 2011,
1). you can only get your ICT extended for MAX of 5 years which means, you are NOT ELIGIBLE for ILR.
2). You cannot switch from T2 ICT to T2 General within UK either.
3). I am NOT sure whether your wife who currently have T2 ICT dependent granted after April 2011 can switch to other route within UK.

As far as i know, u hv least options mate.

there are loads of posts related to your case on this forum. pls do go thru them rather than creating a post since most f the experts might not reply assuming you havent done enough home work.

thanks for looking into it. I have spent good 48 hrs trying to get right answer, but not able to unfortunately. I am really hoping some senior member here will listen to the request and respond.
As far as your resposes are concerned :-
1) Ok
2) Its not for me but for my wife who is a Dependant of mine. Are you saying even she cant switch from Dependant visa to Tier 2 general?
3) Yes, thats where i need some help from some Guru's on this thread

Your spouse can switch to Tier 2 (Gen) but she has to apply from her home country. She cannot do it from UK. She will need a restricted CoS from her new employer. You can read the T2 guidance for the process to assign a restricted CoS.
