If HO have appealed the FTT don't u get a letter from them with a upper tier tribunal date? Or doesn't it work like that? I'm confused if they are appealing they won't send u a call letter??? Sorry for being a pain x
Your case will go to a Judge, he/she will decide if the HO have sufficed grounds to challenge FTT decision, only if there has been an error of law, chances are they will throw the appeal out, still wasted 3 months of your time!
Omg can it take 3months for judge to decide. Are u planning on making a fresh application or waiting around?

@FR9421
Sister, did u paid by bank transactions or by cash in hand ??
Did u make correction after u got refused or u already corrected that shortfall in ur initial applications ??
This things do matter a lot if u paid by cash in hand then HO has strong ground of appeal if not then u will be saved .
When did u make corrections ?

Bank transaction and corrections were made after refusal I think but I'll double check that. Sorry as I've applied again I'm losing track of which application and what.
Please remember me in your Duas and i pray it works out for all of us Ameen!

Hi Mgh,
I'm new to the forum. I had a court hearing on the 25th of Jan 2016 and it was allowed by the judge. However the home office have appealed it.
Just want to know what happens next?? Any luck with yours?
FR[/quote]

Our court dates were exactly the same, could you please tell me how long it took to receive your determination and also how long after did you find out that the HO have appealed against the FTT decision?

My refusal point was that they believe that i want to go to the uk to get married , they had my marriage certificate on my application and i sent it again with my appeal bundle but they still denied it , they didnt overturn the decision , i believe they didnt look at my application properly ,, i dont if their staff need more training ,they keep refusing a lot of people , may allah make it easy for all ameen

Assalam O Alaikum to all, I have noticed after reading this thread that whoever appeals against the decision from outside the UK gets the Review Deadline date but I appealed against the decision from UK didnt get the review deadline date. Does anyone have any idea why is that?

Thanks

very strange that This email replied u this way in my suggestion try this email after two weeks u will get different response .
As far as ur question is concerned Fresh and re-apply both are same just a way of writing and use in context - so in ur situation both meant same .
Note :- you can re-apply and have ur appeal on going at the same so dont get worry about it as the same email stated this as well which u mentioned here.
Every few got lucky in these circumstance, even solicitor are not sure of the positive outcome after giving their 100 percent just one Guy on Facebook got visa while an ongoing appeal.
Another important thing to consider that if u use self-employement documents to meet threshold there would be 60 percent chance of getting refused. As now Home Office is giving lame and false excuses to refuse you are self-victim.

Dont want u to feel down but If u can afford expenses then why not try ur luck may be u will succeeded.
All my sincere prayers are with you .

U can do BRP after 2 days time.
U can withdrew and u should be but u will never get ur money back in any case .Home Office is always eager to engulf ur money.

We applied for our settlement visa (spouse) on 15th nov 2015, which was refused. Can anyone tell me which form do we need to use IATF2 or IATF6? The refusal came with the IATF6 form attached.
Applied: 14/11/2015
Refused: 02/03/2015
Appealed: 28/03/2015
Payment Taken: 20/04/2015
Appeal Notice: 15/06/2016
ECM Review Deadline: 28/09/2016
Overturned

Do you have a solicitor? Also what were the grounds of refusal? You should only appeal if you have a realistic chance of winning in court.
