urgent help

Spouse Visa

Timeline:
Submitted: 21-09-2015 Within UK
Refused: 11-11-2015
Appeal: 21-11-2015
Payment Taken: 23-11-2015
Reason: PTE is not in Appendix O of the immigration rules.

I took the PTE test before 5th of April 2015 which means it was still valid until 5th of November 2015. I sent the appendix O on 5th of April and appendix FM 1.21 which states PTE can be used until 5th of November if taken before 5th of April.

I emailed tribunal last week to chase they said they are very busy and might take upto 8 months to get a hearing date.

I believe if they review my case it is more likely that the HO would withdraw the appeal because it is their mistake.

My question is instead of waiting 4-5 months to get a hearing date can I ask HO to review my case? If yes how?

yes by appealing the appeal goes by the review stage and the entry clearance manager can change his decision within up to 15 weeks and contact you to submit your passport .

I was told that ECM review only applies to people who apply from outside the UK.

you should get directions how to appeal with the refusal letter, did you get any?

Yes, I lodged the appeal on 21st of November and it's been 4 months.

By now you should get your hearing notice or at least your pending appeal notice

Help FLRM Appeal

Hi, I received a letter from the tribunal on 9th of May that my hearing date is 20th of December and they will review it before that. And yesterday I have got another letter that my hearing date is 15th of July. I rang them and they said you have to attend both. I have no idea why is that. Have this happened to anyone else?
