Appeal depends on the area he leaves an availability.

Only if he succeeds will the matter be returned to UKVI to give effect .

Well he was part of this toeic test case and got an out of country appeal. But has know applied for frlo. And it has been rejected so he has applied for an appeal. So i was wondering how long it would be before they respond to him again.

Hi,
My husband is going through the same situation with TOEIC.

He was refused his spouse visa on 25th February 2016 due to the TOEIC (taken in 2012) deception. However we have the right to appeal as we are expecting a child. We would appreciate advice on what will happen in the court hearing (questions and evidence the HO will provide in front of judge) also what are the chances of winning the case?

We have read cases where individuals have won the first tribunal however their case was passed onto upper tribunal, can someone please advice us and guide us with their own experince.

Help will be much appreciated. :)

I have always know that the Home office policy on ETS was a complete sham and was meant to be struck down by any decent court.

Thank God for justice.

The Title of this thread was always appropriate. Theses people were victims and not villain.

Hello,
I lodged Judicial Review in Feb 2015 and it was refused last OCT, they asked me to send amended grounds which i sent them in 7 days. today i have received refusal letter on new grounds which were submitted last OCT.
Can anyone tell me what next step i can take because i have been battling for this for almost 14 months with no luck.
Its mentioned that i can ask for right of appeal from upper tribunal on question of Law only.
and if they refuse then i can ask from court of appeal.
any suggestions ?

Totally unsatisfactory. Whole judgement ought to be promulgated as a matter of urgency. This is an issue of immense public interest and a tremendous amount of people are affected, the least they could do is release it.

Thanks Vinny for updating the thread.

Very troubling case. However if a person makes a human right claim to the Secretary of State before they lodge their appeal, then their appeal will be fine.

But it cannot be done on a notice of decision. Essentially one can see the court is seeking to accord the SSHD an opportunity to certify a claim.

Mr Shazzad''s case is really sad, as it appears that the SSHD did not infact discharged the evidential burden.
