Tier 2 visa refused due to experience salary didn't meet

Post by dahaltn » Sun Apr 03, 2016 7:28 pm

Hi Manci Please need your urgent help, I would really appreciate for that.

Last week my Tier 2G visa has refused due to experience salary didn't meet.

My situation is:
After my master degree in health & social sciences, I got a job and Tier 2 sponsorship for 5 years in SOC 2229 @ £22000/year salary in 2014.
After a year the company's license has been revoked due to documentation issue.
Luckily I got another job and also willing to provide T2 sponsorship in SOC 1184(slightly different but related) @ 27000/year salary which is more than New entrant salary.

Last week we went through the same day visa application for 5 years and got refused saying experience salary didn't meet.

My questions are:
1) switching company due to the company license revocation still need to satisfy the experience salary ?
2) The new company can't pay me more than 27K so can I apply for 3 years visa so that I will be counted as new entrant ? as I had worked only for a years for the first company.
3) To get the same COS, again company need to go through the RLMT process as I don't have much time left.
4) I have given administrative review rights, is it worth doing in my case?

I would be really grateful for your answer
Thank you
Dahal

Sorry for the rejection. But I believe as you were already on work visa since 2014 you must have been become an experienced hire for now. That's why the HO rejected due to salary criteria and related experience for your new visa.

Even if you apply for 3 year you will be still considered as an experience hire, so they except you to be paid £35,500.

You are wasting your time applying for anything.

Let me guess your story...
You were a nutritionist working in a care home... Shock horror you were actually a senior care worker.... And the care home got a visit from some UKVI compliance officers.
Licence revoked.

Now your next ploy is as a care home/centre member of management under SOC 1184. The SOC is for top end health care professional managers primarily in the public sector. You are not in that league. And the use of that SOC is a well worn abuse trend.
There will be no surprise to you that even if your employer raises the salary to the required rate of £29,700 and you get your visa the next step will be another visit from UKVI.....
And the cycle continues until you get the message that wherever you go you will bring about a visit to your Sponsor who will almost certainly be revoked...
Good Luck

HI Nisarmalik
Thank you so much for the Answer,
Just want to make clear
Yes it is different SOC code then the previous one but related field, it mean I am eligible as new entrant if I apply for 3 years?
Q3. To be clear, Company don't need to do RLMT again to get the COS?

Hi iworker,
I am 35 now

Thank you again

You are NOT a new entrant. You need an experienced CoS/salary.

The RLMT will need to be undertaken again if the salary they are going to offer is going to now going meet the experienced level of £29,700 pa.
This assumes the orginal adverts did not state a salary range upto or beyond £29,700. If the adverts covered upto or above £29,700 salary there is no need to undertake the RLMT again.
