Naturalisation--- Traffic Offence

Post by Xcape_24 » Thu Mar 24, 2016 11:53 am

Hi I need someone to advice me on what date I can apply for my British citizenship,I will explain in detail
I was stop by two officers in 2013 driving without a third party insurance (insurance company cancelled insurance and letter went to address so I accepted all full responsibility)
Court date 14th July (6 points £300 fine,fined paid.)
I know am meant to wait three years before I can apply, but the confusing part is I checked my licence on line and the detail is below
Offence date - 11 Nov 2013
Expiry date - 14 Nov 2016
Removal date - 14 Nov 2017.
Has I said my court date when I got sentence was 11 July 2014.
Thanks

The dates you saw online relate to DVLA regulations and when the offence will be removed from your licence. For UKVI guidance on Good Character and The Rehabilitation of Offenders Act read this https://www.gov.uk/government/uploads/s ... _D_v02.pdf

Hi Chinho2k thanks for the reply I was looking at other people's comments in another trend and have seen people saying you can apply 3 years after the court dates.

From what I can understand from the caseworker guide, you're normally ok if you apply for naturalisation at least 3 after sentencing and you have no prior convictions of a similar nature.

Hi,

I had a very similar experience with my insurance policy lapsing by 2 weeks. Fortunately I did not have to go to court, received a FPN 6 points and GBP 200 fine on the spot and the date on the paper version of the driving licence was the day of offence.

I checked on the gov.uk website and registered to view my driving licence details as paper counterparts are no longer valid.

This is what it showed
Offence date 29th March 2013
Expiry date 29th March 2016
Removal date 29th March 2017

So I took a print out and have sent in my application for naturalisation today as it was the earliest appointment available with the NCS and I was physically present in the UK 5 years ago.

I suggest you check your online driver details and see when is the expiry date.

I am no expert. This is only my experience.

Hi keepcalm4,looking at my license online its says expiry date is 14th November 2016,so does this mean I can apply anytime after 14th November 2016,I didn't go court but court hearing and decision was made 11th of July 2014.
Please can you keep me or the whole forum of the outcome of your application as that would help everyone in this situation greatly.

Not sure if u read my other thread. You have to wait only for 3 years after court criminal conviction date to apply if it's not a jail sentence. Check with a good solicitor on the date. I have got my Citizenship and applied for British passport last week. U have to mention ur conviction in the application. My court conviction was Sep 2012. 5 points 500 pounds fine. I didnt know abt the rule change. I thought I had to wait for 5 years. Applied Feb 2016 last week. Got my Citizenship approval April 1st week.

Sam 1983 Thanks I now understand the whole new law,my conviction date was July 11 2014,so that means I can apply after July 11 2017. Thanks so much and I wish you all the best.
