MN1 app for non UK born child while parents on ILR

Post by hussainkothari » Fri May 27, 2016 11:12 am

Hello,

My wife, child (not born in UK) and myself have been on ILR since June 2015. I am preparing to apply for BC. My wife and I will need to sit my B1 exams. I was wondering if I can start processing my daughters MN1 app in the meantime.

If so, what section shall I be applying for?

section 1 (3) birth in the UK to parents who are now settled in the UK or have
become British citizens.
 section 1 (3A) birth in the UK to parents who have joined the armed forces.
 section 3 (1) child whose parents are applying for British citizenship.
 section 3 (2) birth abroad to parents who are British by descent and have lived
in the UK or a British overseas territory.
 section 3 (5) birth abroad to parents who are British by descent but are now
living in the UK or a British overseas territory.
 section 3 (1) children adopted abroad by British citizen parents.
 section 3 (1) children whose parents had renounced and subsequently
resumed British citizenship.
 section 3 (1) any other case not listed below where it is considered to be in the
 child’s best interests to be granted British citizenship.
 section 4D birth abroad to parents serving in the armed forces.

Thanks,
H

Child shouldn't apply before a parent's naturalisation application.

Yes. Child already has ILR since June 2015.

Have you clicked on Vinny's link 'shouldn't'?

The child should apply when either of the parents apply or once a parent is granted citizenship.

Hi, My wife and child will apply for BC while I am still on ILR.
Please can someone confirm that this (one parent on ILR while other and child applying for BC) OK?

Thanks,
H

Should be okay, although it may be better for child to apply after mother's naturalisation is approved, in case of problems with her application.

Thank you vinny and CR001 for all your comments.

My wife and my daughter will be applying for their BC (via NCS) on the weekend. I would be on ILR.

The docs that she would be submitting are -
1. Application form and fees - AN and MN1 Section 3(1)
2. LIUK
3. B1
4. Passports and BioM
5. Birth certificate - child
6. marriage certificate

Please do shout if you think there may be a problem.

Thanks All. Application submitted for an adult (T1 dependent -> 1 year+ on ILR) and a child. Received the ack today saying "Type of Application - AN6(1) + Ceremony + MN1". Hope this is the correct category.
