Salary to my dependent counts as investment?

Post by yoshinoya » Tue May 31, 2016 10:48 am

Hi,

I am posting for the first time. Sorry if I sound inexperienced.
I am on Tier 1 (Entrepreneur) 200k route with my wife as my dependent. My wife will be helping me with my business. Just wonder if I pay my wife a salary in line with the market (e.g. 20k per year) to reflect her work, will that expense count as part of the 200k investment?

I understand director's remuneration is not counted. But it is uncertain when it comes to a salary for dependent.

Thank you so much for your assistance!

Yoshinoya

If your dependent is settled person holding ILR of uk or EU citizen or British citizen then yes otherwise it is not eligible please look for guidance which clearly states who you can employ so you can hire them to claim points.

You can keep your dependent as your employee and pay him/her. But you can not claim this for job creation points

Thanks for your reply. I understand the job creation requirement.

I am paying my wife a salary as part of the investment to score the '£200k invested' points.
I will hire another two settled workers to score the job creation points.

@ yoshinoya, you can use the salary paid to your dependant as part of your 200k investment funds, but your dependant will have to be part of your employee and doing job which you can defend if queried.

But since your dependant is still under visa rule, you cannot use her to claim employment creation points for the purpose of visa renewal as others have stated.

Under business rule, you can employ whoever you so wish as long as such individuals are allowed to work in UK. UKVA even stated in the guidance note that you can even employ people who have permission to work for you through Tier 2 sponsorship which you got for them, but such individuals cannot be used to get points for employment creation.

You can legally hire her but I suggest you stay away from it. HO might think that you are recycling you investment back via your wife to claim investment points. Don't take unnecessary risks

If she has s experiance in your business field than you can buy should be defendable.
I would suggest not more than part time.huge amount like 20000 is not ideal.
I hope your understand my point.

@ Business2business and ishfaqsangra, thanks guys. Sorry that I haven't been partaking in the forum for sometimes now due to tight schedules. Will definitely find time this days.

Hope your businesses are doing great.
