In order to apply for the PR you need to show documents for living in the UK for 5 years. I am pretty sure that you should be able to choose the 5 years you want and submit the relevant documents. If you have been continuously living here for more than 5 years, than it is up to you to decide on the period you want to submit the documents .
Lets see what other users say , hope I am not wrong but this is what I understood after I called myself the UKBA helpline when I applied.


Hi. I have called HO same sort of issue, my wife was self-employed, employed and now housewife, and we married in 2011. They told me she can apply for any 5 consecutive years....she came in 2007. She will apply 2010 - 2015.

No news here either. Still waiting to see any cards issued after the Brexit vote, but all that have posted were issued before.

Hi all,
Once again I come back to this great website as it always offered invaluable help and information.
I have in Jan 16 applied for a PR as a family member of an EEA National (I'm a Non-EEA national). I have lived and worked in UK under that status since 2009 and my partner has lived and been a full time employee in UK since 2008. We are both still working as full time employees and we've always lived together in UK. We started a new family in Nov 2015 with the arrival of our first child :)

My time line so far is as follows:

PR application sent: 20 JAN 2016
Biometric enrolment letter received: 08 FEB 2016
Biometric enrolment submitted: 09 FEB 2016
COA Letter received: 08 MAR 2016 with right to work until all appeal rights exhausted.
I requested passports back: 30 MAR 2016
Passports received: 19 APR 2016 and HO instructed not to send anything back to them.
Decision Letter: PENDING
PR Card received: PENDING

As you can see, pretty much in 2 weeks it will be 6 months since I applied. I haven't heard from them again and it is worrying me a bit. I would be gratefull if you could please help me with my questions below:
- Should I be calling the HO already? if yes do you know what are the best numbers to call or emails so I don't fall on deaf ears?
- I was unfairly arrested in FEB 2014 as some random girl reported my car number plate as someone she recognised to have indecently exposed to her some months before and she thought it was me. Of course I wasn't charged and I was given an NFA as I had no relation at all with such an act. Could this be affecting my application? I did not mention it in the application as I was never charged for anything or ever arrested in the past.
- The COA letter tells to my employer that I am able to work in UK only until my appeal rights are exhausted following the decision over my application. If they were to refuse it (which I can't imagine why) is it actually true that I lose my right to work in UK even if my wife is still an eligible EEA national working in UK and I have lawfuly aquired my permanent resident status in UK back in 2014?

I've just received the passports & Eu IDs we've requested back long time ago, however the other documents requested such as Marriage certificate, Driving licence and Birth certificate were kept as evidence to support our application. So there is my updated timeline.

Hello we are resident in the UK for 8 years as German citizens, and are now looking to apply for a document for PR and am concerned if I need to apply for a registration certificate first before applying, so am looking for advice

The EEA(PR) form asks for a Home Office reference number which we don't have, and for the absences we cannot remember any of the dates of our holidays to Denmark in 2008 (but know it was for 2 weeks) or our holiday to France in 2009, so I am unsure on what to put... :?

I had quite a lot of travels and I couldn't remember 3 of them , I mean the exact dates. I had an idea of the month but I was not sure. What I did, I approximated the dates to the best of my knowledge and I got my DCPR with no issues.

I don't think you need any registration certificate since you both are EEA nationality. I didnt have one for my application.

This should be the only certificate/document you need to apply for. They introduced this as a requirement for EEA nationals as part of naturalisation from November 2015.

I think they are unlikely to speak to you for another 2 weeks to be honest. I have seen a few non-EEA applications taking very much to the 6 months mark on the site before, and I would expect they are unlikely to get faster at processing with the recent rush for applications, so probably no need to worry unduly, just call them on the 6 months and 1 day mark.

The form states criminal convictions, civil judgements or civil penalties (and of course the extremes). If you were not charged with anything and given an NFA, then I do not see why it should affect your application, as it was not a conviction.

Thanks for the reply Bumble. I have waited 6 months already, I guess I can wait another 2 weeks :)

Regarding my last question, what really happens with family members (Non EEA NAtionals) of EEA Nationals who are refused permanent residence? Do they lose their right to stay in UK as a family member?

My PR application arrived at the HO on 20/4, so I am hoping to receive a reply later by the end of July the earliest, the latest by 20/10.
At the time I applied, I knew I was going to move home, but as it was not 100% guaranteed, I I added my old/current home address and my gave my work address as correspondence address just in case. I will be moving later this month and worry the HO will still post my docs back to my old home address as I read a couple of stories here where people's PR and docs got lost because HO did not use the correct address.
I try to use the HO link to update the address, but it is asking for my passport number. However I included my ID card in the application pack, not my passport number. CAn I use the passport field for my ID number?

I phoned HO today to query about the current average waiting time for EEA PR and was told 6 months...6 months of potential uncertainty in these otherwise already uncertain times.. yay!

I would not worry too much about what they say - they have said 6 months for EEA PR always even back when EU citizens received theirs back in a month. It seems non EU take the full 6 months, but EU at the moment are roughly half that time.

... having said that still not seen any DCPR's dated after the referendum... anyone who has received theirs recently please update your time tables so those of us still waiting can get a glimmer of hope :)

I am getting worried as it is 98 days now and I am still waiting for my DCPR. I posted it a couple of days after confuzzled83, who got it on the 25th (dated the 16th). I even got the confirmation email prior to the date shown in confuzzled83's timeline.

I know they say it is 6 months but it is usually less than that and we were in around 80-90 days last month. My case is crystal clear, 6 years working for the same employer, living at the same address, etc... I sent a note stating all the documents provided so reviewing my application should be pretty straightforward!

Are you an EEA nationality or non-EEA? because as far as I can see from other people application the average 80-90 days is applicable only for EEA nationality and the HO usually took a bit more time for non-EEA applications.

EEA.

I am aware it takes longer for non-EEA, but in this case I am EEA (non-A8).

I understand...fingers cross it will come soon! Maybe especially with the Brexit they might have a huge number of applications. Since you have all the documents OK don't worry about it, it must come.

Their customer service is appalling. I called them a few times (they still haven't sent back a document I requested months ago) and every single time they told different things, though all of them advised me to wait "another 2 weeks". :x
