My ILR (Tier1 5 years) was refused last week after 11 months (reasons- they are not satisfied with my self employee earnings ). Now I need to do an administrative review within 14 days. I think AR is just a waste of time and I need to do a Judaical review. Is there anybody with same experience.

Are they reply to the AR within 28 days or will it take longer?

Hi WInter Summer,

Just remain positive, I believe something good will come through for you in the JR.

Did you do tax amendment and made payments to HMRC?

Thanks. No tax amendments. Paid in full every time. unlucky I guess.

Sounds like you will defo get you ILR soon winnter_summer. Cant see why they would even reject when you have no amendments and paid in full. Just not right.

I called the UKVI yesterday (4 November 2016) to find out about current processing times and the gentleman on the phone was very helpful. He told me that the UKVI was currently processing ILR applications made on 18 May 2016.
My application was made on 28 May so expect that it will probably be processed in the next 10 days or so. The UKVI agent on the phone said that there is no direct relationship to the dates but that one could reasonably expect that my application would be processed within the next 2 weeks.

Hi Raibot any update mate? i applied 1st week of june.

Hi All,

I really need your advise as I have received an invitation for interview at a VFS office in central london. Is anyone in the same situation or been to an interview there? What are the likely questions as it seems outcome from interview has not been favourable.

Nothing from HO still counting days and nights, only 2 weeks left to complete nine months...
I have got calculation from HMRC, and haven't sent anything to HO. I will not send it unless they ask as it is not requirement.

Best luck trunks2k8

Hi rocktheparty,

HMRC provided me updated SA302( for year 2013) on paper only. Yeah your online records not supposed to be updated and that is why its not available online for home office. However I asked HMRC compliance officer about this particular issue and he told me if any other Gov department will come to us (like Home office) to check and ask your records we will refer to our notes and we do correspondence according to your UTR (updated notes). HMRC and Home office (both) are well aware what exactly going on since last year 2015. Many cases are there in the list for same issue, late payment, accountant mistakes, missing records etc.
Legally there is no issue for late amendments and sorting out your tax matters before visa granted. I know couple of my firend's who contacted to HMRC and HMRC hasn't updated their records till now but they still got the visa as Home office deals every application differently ... again I must recommend to have solicitor in order to deal with this type of typical cases as home office not going to argue with solicitor as legally its fine ;)

Cheers

Hi tt2016

Thanks for your reply. You received positive decision in re application with in 3 months. That's good.
I too reapplied through a solicitor but HO hasn't made any decision yet. It almost 6 months now.
Did you add any accountant letter in your reapplication mentioning the cause of error in old SA returns?

Has anyone who applied in June had their applications considered yet? Really worried as mine is getting close to 6 months since I applied.

Hi tt2016

Thanks for your reply.
Not asking exact figures, but can you please provide approx tax you paid after amendment. And any reason assigned for why incorrect SA was done at first place.
It will be good to know how we can make our application/reapplication better.

No news on my application yet.
I did get an email on 14 November from UKVI saying that 'your application is still under consideration and we expect to make a decision within 6 months of the date of your application, which is our service standard.' It is now just 10 days from the UKVI's service standard of 6 months since I made my application and I am puzzled that they have sent me this email.
Incidentally, this is the only email I have had from the UKVI since their first email acknowledging receipt of my application unlike other applicants who seem to have had emails every month.

Meanwhile my nearly 80 year old mother has had an accident in my home country and she has fractured her spine and sadly I am not able to travel.
It's a sorry state of affairs for us entrepreneurs!

I dont have any peace of mind!
Is any one in same situation as me ?

Thanks to Almighty, by the Grace of Allah I have received my ILR. I applied via Tier1 (G) route.

I just wanted to share my experience with you all, in particular with all the folks out there who have done tax amendments and are waiting for outcome of their application.

I would strongly advise hold your nerves and just wait you will get a positive outcome. I had a tax discrepancy for the year 2010-11 (my initial application,) which I only realised in Sep last year and contacted hmrc for amendment, which was done early this year but no sa302 was updated just recalculation was sent and I paid the tax due as per recalculation straight away. I sent my case to HO in May and ILR received in November, nearly took 6 months.

My advise to those who are looking to apply for ILR and have done tax amendments, keep your case as simple as possible and only send documents that are required as per application form. I kept my case very simple and only sent documents that were required i.e. for previous earnings; as I am employed, I only sent 12 moths payslips, employer letter and bank statements, I did not feel the need to send documents regarding my last 5 year earnings as there is no mention of this in the application form.

To all folks I pray you all receive your ILR soon.

Good luck.

Hi Everyone,

I spoke to the law firm which did my application on Friday (the 18th). They said that most of their ILR applications via the Tier 1 (General) route are being approved on, or within a few days of the 6 month mark.

Has anyone heard any additional anecdotal information on how long Tier 1 (General) applications are taking?

From looking through this forum it looks like the Ancestry ILR applications are taking about 5.5 months to process, while the Tier 1 are taking a lot longer.
