Dear PAK,
To be safe side, 2/1/2017 will be the date your friend can go for premium service for his ILR. Otherwise, he will be eligible from 30/12/2016. However, dont take risk. Thanks.

This is my situation. I Came to UK as a student in Feb 2005. Then my visa expired on 31/10/2006. My college sent my passport for extension 9 days late (10 Nov 2006) but sent without the passport photos (idiots). HO sent the docs back to college and college sent the docs back with the photos end of December 2006 (59 days late and I was over stayed that period). I applied for 10 years LR in Feb 2015 and got refused as my stay was broken in 2006.
Now I will complete 10 years again (After the over stay in Dec 2006). Would you think I am eligible for LR as I completed lawful 10 years stay in UK ? Please share your thoughts. (currently I am a tier1 dependent)
Please reply to my query

Dear, please tell me exactly the date u first got the visa after 59 days overstaying. Additionally, do u have any breaks in ten years other than 59 days? Please write down your timeline from the first visa you obtained to till. I'll tell u exactly when you are eligible to apply for ILR.

Applied for ext 10/11/06 without the photos. Rejected in 05/12/2006 because no photos.
Re applied on 28/12/05 and granted on 24/01/07
Then no over stay after that. But had few holidays (2, 3 weeks at a time)

Dear ncl79,
First year of entry had broken as new 10 years lawfully residence had been started since 24/01/2006. However, 'Long Residency Rule; page 14 says,'if your ILR refused, once you qualify then can reapply again, p.24. Therefore, best safe side will be after 28/12/2016.

Dear Moderators,

Your help will be very appreciated.

Ques1: What will be the Qualifying date (28 days) to apply for ILR Long Residence?
Is it based on the entry date or issue date of the 1st Visa?

* 1st Entry Visa issued on 07-Feb-2007 out side the UK
* Entered UK on 24-Feb-2007

My kind regards,
Shane

For long residence ILR it is based on the date of ENTRY to the UK. So you can apply anytime WITHIN 28 days before 24th Feb.

Hi,

Please I have a question. I entered UK in January 2010 as a student. In May 2013 my dependant visa application was denied because I should have made the application from home country rather than from UK (I also applied 2 days late) so I travelled immediately to apply abroad and was granted. The time of refusal to the grant of visa abroad was about 4 weeks.
Please how do I calculate my 10 year stay? Will it be from 2010 when I first arrived (minus the four weeks I had to travel to get visa) or has the refusal in 2013 cancelled this out?

Thanks

Estee

If you submitted an application after your student visa expired and then left and re-entered the UK, your 10 years will count from when you re-entered the UK in 2013. However, asking this question so many years early to when you will qualify for ILR based on long residence is pointless as the rules could change.

Dear Estee,
Please quote that probably majority the person who are
advising you here not solicitor. Just on the basis of our experience, we are sharing some knowledges. If your 3c didn't end and you return to your country of origin and come back within 28 days with a new visa then the 28 days would be disregarded. By relying on the flying advices by the so called lawyers, I am suffering with the same problem. Therefore, your matter is the critical one and don't just waste your three years. Please do ask any immigration expert barrister about your issues by spending couple of pounds. Thanks.

This thread has become such a jumble of questions & answers that posts are easily lost and forgotten.

How soon after the spouse visa refusal did you submit a private life application?

Hello, I have one more question. what is the answer to question D2 (immigration history section) of my LR application. It asked the date First entered date to UK and it says this refers to the date of first entry to the UK at the beginning of the period of stay on which this application is based?

Dear, if you filling in the ILR application then you will have to the beginning address which 4/2/2005. But if you count the day for 10 years then it's going to be 24/01/2007. However, please do get advice from a expert lawyer.
