Does Change of NHS trust with new job reset Tier (2) time?

Hi

Start of First NHS trust Job :2nd Dec 2012
Tier 2 granted for 3 years valid till 2nd Dec 2015 ( Job was on SOL)
Left First NHS trust on : 6th March 2015
Joined New NHS trust with New tier 2 applied for 5 years along with 3 dependants on 15th March. New tier 2 was granted for 3 years and 8 months based on remaining time left in 6 years. ( Senior level job in same field but was not in SOL )

Question:

Today one of the immigration lawyer said i cant apply for ILR. ( i am not convinced) as as per details above i think i am eligible 28 days before expiry of 5th year. i.e 2nd Nov 2017.

As per lawyer as i changed the employer and applied again so my time of 5 years will get reset.
