Urgent!!! T1 Entreprenuer extend application refused

Hey Guys,

Thanks for the people who clicked in have a look in my case.

I have received a T1 entrepreneur extension refusal letter today. Simply because Home Office caseworker did not received the letter of my bank to prove I have a UK business account. My refusal letter is based on 46-SD(c)(ii). And according to the new rules 245AA, evidential flexibility does not meet in my case, thus I did not given a chance to resubmit the letter.

Ironically, I cannot remember whether I submitted this Bank letter or not with my application. However, I am a genuine UK Business owner with 3 employees and have been trading for 3 year+. The shame is the Home Office assess the authenticity of a business is based on submission of a bank letter,and no chance for re-submission.

The only chance for me is seeking administrative review if this is a caseworker error. However, as I mentioned even myself not sure if I submit the bank letter or not. Getting a bank letter is easy, but If home office lost my bank letter, How can I prove this is their error??

If you have provided any document which shows your company has a UK Bank account, that's what HO requirement.
If you did not provide them any Business Bank account document, then most probably you wont win the AR.



Its £50 K or 200 ?
Time line ?

No, I did not. But I am not sure whether provide the Bank Letter. What if I provide the letter, and HO lost it and I dont get a chance for resubmission.

Unfortunately, I did not print out my Business Bank Statement. Only the bank letter

My oriental Visa expired on 22nd October 2016.
What if I can ask my bank to reissue the bank letter to prove I asked the letter before?
However, I am not sure how can I prove if HO lost my document.
I am more worried about my clients and my employees.

What if I can ask my bank to reissue the bank letter to prove I asked the letter before?

You should have the bank statement otherwise how you can proof you have invested £50K in your business.

sry to hear about refusal. when did u apply? have they refund u IHS ?

As other people already have mentioned that you must have submitted business bank statement to show investment.
That is also an evidence of having business bank account in the UK.
If you have done that then you must go for AR

Have you got partial IHS Refund ?

I think you still can apply for fresh application even your current visa has been expired.

Have you provided them business bank statement ?

But i would say you should consult a good lawyer.

I applied in October 2016. I am not worried about the IHS.
HO will refund the fee if AR is failed which is on my letter.

I have not submitted my bank statement.
I have a good chance submit Business Bank letter though which I need to check with my bank, hopefully they keep a record when I record the letter.
IHS is not refund. which will be considered by HO if I give up on AR or AR is refused.

To prove investment you need to provide both personal and business bank statement,,,,how can only accountant letter?

Yes you can. Wait for your admin review and if it is negative you can reapply within 14 days. Make sure u have updated documents like maintenance etc
Did you not fill the page on your application where it asks you to list the documents you are submitting?
That list will tell you if you did or did not submit the bank letter and if it is listed then you have a good grounds for an admin review.

What is the specific statement on the refusal letter?
