Applying for PBS Dependent for my Wife and Kid

Post by Ramanaguru82 » Mon Jan 30, 2017 10:21 pm

Please advise me on this regard,
Below are my details
I'm British Citizen - received during Aug16 via Tier 1 general visa route I.e got first entry clearance on April 2009 under Tier 1 general and continued for 5 years to obtain successful ILR and then British Citizen.
My wife and kid are in currently Tier 1 dependent visa which they got on 20 March 2014 and is about to expire on 10Feb2017.
I'm in need for extending their visa to get proper ILR later. Hence which visa type I need to go for now.

Also recently 2 weeks back my wife and kid visa got refused when they applied Tier 1 dependent partner/kid visa from India stating that I hold British citizen and they are not applicable to apply Tier 1 dependent visa under Sec 319 (C)1. Hence they are travelling on urge to get renewed inside UK as their visa is expiring by 10Feb17.

That's correct.

They cannot apply for entry clearances as PBS dependants. However, they may return and extend their leave as PBS dependants in the UK prior to their visas' expiry.

Thanks Vinny for sharing this link which is very useful. And that confirming I can pursue under PBS Tier 1 dependent visa for my wife and kid.

Regarding their continuous stay in UK details as follows.
My Wife first visa received as Tier 1 dependent partner on 12Feb2013 valid until 10April2014 in India and she arrived uk on 25Feb2013. Then she went to India on 06August2013 for delivery. Then she applied Tier 1 dependent partner visa again from India during march as her previous validity was until 10Apr2014 and received new tier 1 dependent partner visa valid from 20March2014 to 10Feb2017. She then arrived to uk with baby on 6May2014. Later she went on holidays from 31Dec15 and returned on 24Mar2016..
Will that be fine or any concerns please

I am a bit concerned if she was absent between 06 Aug 2013 and 06 May 2013, then this may be over six months in a five consecutive 12 month periods preceding the date of the application for leave to remain.
