Changes to immigration rules

The Home Office have issued the latest statement of changes, which formalises new legislation coming into effect from 6 April 2017. The main changes include:

- Introduction of the Immigration Skills Charge for Tier 2 workers. Employers will have to pay a levy of up to £1,000 per year of sponsorship for new Tier 2 workers, though there will be some exemptions, and a reduction for small or charitable organisations.

- Extension of the Criminal Records Certificate requirement, affecting Tier 2 Entry Clearance applications for jobs within the health, social care & education sectors.

- Changes to evidence required for Tier 1 Entrepreneur extension applications, including to documents required for showing that someone is a settled worker for the purposes of job creation, and a new requirement that bank statements show business transactions.

- Changes to re-entry bans: currently, anyone who has overstayed by 90 days or more is subject to a 12 month re-entry ban. This period is being reduced to 30 days, in order to further discourage anyone from staying in the UK without valid leave.
