Confused over Child Policy Registration

Confused over Child Policy Registration

Hi all

In this forum I was reading that if One of the parents has ILR then the child can register as British but when I asked my solicitor, he said one of the parents has to be British (not ILR) for the child to be able to register as British - Does anyone know what the truth please ?

Ur solicitor is wrong but child should born in Uk

Thank you for your reply - my son was born here and I'm about to apply for Ilr next month so it does help to know - any idea what form I can use to register my son please -thank you

Form MN1 and it is an application under section 1(3) of the nationality act.

If you had held ILR (or citizenship) when your son was born, he would have been British at birth, and you could applied for a passport for him straight away. That may be what your solicitor was thinking of when s/he advised you.

Once you have ILR, you can register your son (assuming he's still under the age of 18) as a British citizen with form MN1. So to answer your question, no, it doesn't matter what sort of leave to remain you had at the time he was born, so long as you have indefinite leave to remain once you register him.
