FLR(Fp) please need advise

Hi I'm reading this forum about a year but still can't find a similar situation like mine
I was refused by HO when applied to retain my rights after divorce with EEA national on the base I didn't work while was pregnant
Got a refusal with right to appeal it didn't appeal after consultation with solicitor that there is no point of appeal but HO retain my passport as I had visa till 2019 as EEA family member
Now I want to apply as a British partner and two British kids
My concern is how can I state in FLR (fp) form about my passport
Don't really wanna use solicitor if I can do it myself

hi personally will say you should write a cover letter regarding you passport on a separate latter if possible also put your last case reference number as well as your application form.

Also on the form with BPr details what shall I fill ? Cos on retain rights of residence applications I did my biometric
Do I need to fill that I had one before ?

Why did lawyer said you should not apply? because the lady was pregnant during the divorce or you?

I don't think that was a correct advise, you ought to have appealed, as all your right will be lost if you don't.

Are you the mother or father of the 2 kids.

I am a mother of two kids
Well basically before and on the time of divorce with EEA national I supposed to work
As we sapareted with an EEA NATIONAL long before divorce on the time of my divorce with EEA national I was in relationship with father of my kids it's just divorce took a bit long time
So on refusal letter it says that I didn't work and As I was pregnant and if I had health issues during pregnancy then provide a letter from Gp
I spoke with few lawyers and all of them said the same thing that even if I appeal the right is on HO side
The rule of retaining rights is working on the time of divorce
I hope I explained properly ☺️

Hi can you please help me maybe someone had similar situation
Can I apply on premium service for FLR(fp) if my passport is retained in HO since January 2017 ? If I can is it better do uSe solicitor or I can do it myself ?

You can apply in person but you are unlikely to get a decision on the day if your documents are not at the premium centre.

I was thinking to notify a home office to send my passport to the Croydon before my appointment so they can have my documents right there cos I can't go to Liverpool from London

The premium centre in Liverpool is not where your FLR(FP) application is. You cannot go to the Liverpool COD offices to make a visa application, they won't let you in.

Just spoke with premium service in Croydon and they said I can't apply on this service only postal 😩😩😩 wich means waiting loooooong dreading months for decision

Two questions

1) Are you married?
2) Do you have a National ID card from your home country identifying who you are?

Husband's timeline - overstayer 11 yrs
08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.

No unfortunately my country doesn't have ID cards only passport
Not I'm not married but me and my British partner living together for 6 years and have two British kids
The only part is confusing me it's a passport thing and cover letter to HO
I guess I will need a solicitor πŸ€”

The section stating why you're not submitting your passport should state simply that the HO had retained it. Going with a solicitor or not will only make a difference with the cover letter. Read through the rules and guidance notes, make it clear with regards to why you are going through a FLR. A professional may help, but I really feel that if I had more time to read up on case law and what is required. If you can afford it, go with a solicitor that is reputable.

I decided to do postal only question about income cos my British partner is claiming HB cod of low income due to his health problem and on our both names CTC AND WTC
will ho refused my application cos of benefits

Hi I'm preparing a FLR(fp) form but my partner is claiming benefits and on low income . We have two kids and receiving CTC andWTC. Housing benefit
Will it affect my application ? And what about finance what is the minimum ?

But what about benefits ? And his income is low cos he doesn't work much due the health reasons
So HO Doesn't look on financial part in FLR(fp ) at all ?
