Hello,

I was given work permit on 16/01/2006 for 60 months till 16-01-2011 and my wife and child (aged 7) were dependants.


On the basis of long stay in U.K.(10 years), I was granted indefinite leave to remain about 14 months ago on 3/11/2006 at PEO Glasgow.
However I was not allowed to include dependants in the application form.


I remained under the impression that we need to apply for extension of leave to remain(FLR m form) for my dependants only one month prior to expiry (16-01-2011) of the existing leave to remain.

Only when we approached PEO Glasgow in person with the completed FLR(m) form and all the documents last week, we were made aware that this had to be done earlier and they advised us to have it done by post with a covering letter to the officer incharge as this required some detailed enquiries to be done and would take 8-12 weeks.We have sent all the required documents by post with the covering letter .

Will our application form be successful?

All responses would be appreciated.

Totally impossible to say. That will depend upon the information on the form, and the supporting evidence.

WE have sent all the correct documents and all the information given on the form is correct too

My guess is SYH is on a wind up.

But there are problems. You should have made the application at the soonest opportunity, and there is an argument to say that they have been here illegally for this time.

What section of the Immigration Act and Immigration Rules would lead to this suggestion?

Hello

The Guidance Notes for SET(O) form does not say that SET(O) and FLR(m) forms should be submitted together or at the same time for ILR applicants based on long stay in U.K.(10 years) ????????

Since time travel to the past is not currently possible, just be patient.

BTW

1. I am still with the same employer and same job, for which the work permit was granted.......

2. was my understanding incorrect here - once LTR is granted it will remain valid until the expiry date, unless HO cancels it in writing?

I wasn't try to wind anyone up, I was really agreeing with John as to who could know without more info.

As we are not psychic, and we do not have hotlines to the Home Office, we cannot say whether the application will succeed or not.

And 'please' is a nice word. You could try it sometimes.

SUCCESS !!!

My FLR(M) application has been successful
I recieved it today, it just took 3 weeks!!!!
Honestly, never expected it so quick...

My husband has ILR and my daughter (7 yr. old) and myself are on the 2-year probationary period....

My query is :?: - Can my husband claim ' child benefit ' for our daughter ?
