Hi All,

I am in a difficult situation here my younger brother who was looking after my mom has passed away and there is no one to look after her now back home, I am a British citizen and I only can look after mom but I cant move back as my family is here, if I apply for visit visa first of all its a rear chance she will get it as she no longer have ties in pakistan, secondly she can only stay for 6 months in a year. I have 2 sisters back home but they themselves are dependent on their husbands.

I am thinking of applying for settlement visa for her however I have heard it's almost impossible to get.

Please advice if I can apply for adult dependent or if there is any EU route as my wife is an EU national.

Unlikely you will get a adult dependent relative visa, especially if there is family in Pakistan.

You have to meet very difficult and strict requirements for this visa.

If you apply and it is refused, it shuts to the door to any future visitor visas.

For the EU route, what evidence do you have that your mother is dependent on you/your spouse?

Is your wife EU citizen only or dual EU/BC?

Is your wife exercising treaty rights?

That's what I am worried about if i apply for her settlement she will no longer get visit visa.

My wife is doesn't have BC only EU citizenship, she has a PR and is working.

As my brother is no longer with us and I am back in pakistan looking after mom at the moment.
Due to the change in circumstances we are the only sponsor she has now.

You will likely need more than that. You need documentary proof of dependence.

Regular financial transfers, that kind of thing.

If your partner is a EU national, EEA FM would be the easiest route would it? (Correct me if I'm wrong admins) rules are below. Look at the guidance notes. The ADR is incredibly hard to get, but the EEA FM looks sound enough to meet your needs. If agreeable to the admins, move this post to EEA board for further help?

Which family members can apply on this form?
If the relevant EEA national only has a right to reside in the UK as a student, you must be the:
• spouse or civil partner of the EEA national, or
• dependent child of the EEA national, or of their spouse/civil partner.
In all other cases, you must be the:
• spouse or civil partner of the relevant EEA national/British citizen,
• child or grandchild of the relevant EEA national/British citizen, or of their spouse/civil partner,
and be aged under 21 or dependent, or
dependent parent or grandparent of the relevant EEA national/British citizen, or of their
spouse/civil partner.

08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.
