Post by Babajee85 » Wed Dec 06, 2017 10:16 pm

Hi folks,

I am British Citizen and working full time in UK.My wife was here on Tier 1 Dependent Visa for Two years 2012-2014.

From 2014 till now she is living back home. Can she apply for the marriage allowance because she never did a job in the UK.I am going to apply for the spouse visa soon for her to be here but can she apply while living abroad.

Please advise,is she eligible to apply ?

Thanks

No.
Thanks for the swift answer.

but Gov.Uk says :

Who can apply
You can get Marriage Allowance if all the following apply:

you’re married or in a civil partnership
you don’t earn anything or your income is £11,500 or less
your partner’s income is between £11,501 and £45,000 (or £43,000 if you’re in Scotland)
It won’t affect your application for Marriage Allowance if you or your partner:

are currently receiving a pension
live abroad - as long as you get a Personal Allowance.

So as per my understanding everyone get the personal allowance each year once irrespective of that you work or not...isn't ?

She has the UK NI number though she never worked but she is eligible for personal allowance by default.

Please clarify...

Thanks

But she has no rights to live in UK let alone pass any UK rights on. She'd need LTR I'm sure.

Did you click on the link that explained who gets a personal allowance?
You’ll get a Personal Allowance of tax-free UK income each year if either:
  • you’re a citizen of a European Economic Area (EEA) country - including British passport-holders
  • you’ve worked for the UK government at any time during that tax year
You might also get it if it’s included in the double-taxation agreement between the UK and the country you live in.
This seems to be a complex tax question and not one for an immigration forum.
