Did you request your daughters passport by yourself? Just think on positive side. Atleast they are now dealing with your case and soon your decision will be made.

Hey everyone!

Just an update for you all...

We got a reply to our FLR (FP) application from August 31st 2016. We received a decision around October time this year and it was a refusal.

Luckily, as there was a recent court ruling on in-country appeals, we have the right to appeal within the UK and have instructed a solicitor. We had a date for the hearing and it's been adjourned, so hopefully we should get a new date for around January time where we can put our case to a judge who will rule in our favour.

The case is pretty watertight, so hopefully it shouldn't be a problem getting a judge to see reason.

Yes, the HO stated that although life would be difficult, it would be possible for me to move with my husband to live in Thailand (the country he is from).

I should note at this point if you don't already know my case info, that we are in a same-sex marriage, something Thailand doesn't permit or recognise, regardless of whether or not a marriage certificate is held from another country where it is legal. The situation is that I can't get a Thai spouse visa to move there, as they don't recognise our marriage, and so the only option available to me would be tourist entry clearance for 60 days at a time, then taking trips to a neighbouring country and re-entering on a new 60 day clearance every two months - this is essentially what the HO are suggesting.

We are saying that this is totally beyond reason and that he should be allowed to stay here on the basis that there are insurmountable obstacles to us living in Thailand (there are other things stopping us moving to Thailand, but I'd rather not get into those on a public forum).

Ha the OP returns! Welcome back and really sorry to hear about the refusal. In a lot of cases, the only thing that one can do is rely on the good judgement in a court that will rule in your favour. Glad that you were able to appeal and take it further. What a long wait. I would wonder why on earth would they make you wait for so long then to refuse. Still waiting for 16 months (We applied 23rd Aug so not too far off from you)

It's crazy I know, you'd think they would just deny it immediately but it seems applications just sit in a drawer for years at the HO.

Good luck with your application, I can't believe it's taken so long :shock: ... if it doesn't come back with the result you wanted then there's always the appeals process which should be significantly quicker than the initial app. 8)

Our solicitor said it might take 6 months - 1 year to get a hearing and then within a few weeks we got the letter in with a date. I think it just comes down to how busy the courts are, where you live etc.

We're up near Glasgow so our local immigration tribunal centre is in Glasgow... which doesn't seem to be anywhere near as busy as those south of the border and, in particular, the south east.

Unluckily after waiting almost 1 year and 2 months got a refusal, they accept family life but raise an issue about TOEIC which doesn't make sense if you have a family life so same got the right of appeal and have 14 days so hopefully we will get the date soon for hearing.
