Hi Ola

The law governing EU nationals and family members as per Free Movement Right is Immigration (European Economic Area) Regulations 2016 as amended and NOT UK Immigration Rules. Hence, it is permissible to challenge your refusal while still putting in fresh application.

This means you can challenge your refusal and, at the same time, make fresh application. They are not mutually exclusive.

20. APL1.20 Applicant makes fresh application while an appeal is outstanding

A person who has an appeal pending can make a fresh application for entry clearance in the same or any other category. There is no requirement for a person to withdraw an appeal. If an appellant is subsequently issued an entry clearance, post must inform the tribunals service at: eco.contact@hmcts.gsi.gov.uk. The ECO must ensure that a proforma of withdrawal of decision is also sent to the Tribunals Service and this appeal will stop.

Hi.. My husband's passport came today with visa. Applied on September 15th from Mumbai India. We escalated once and visa came within 15 working days as they said. It was not straightforward.

Hello,

I have been looking at some info but couldn't find an update.

The "processing times" UK Gov website does not seem up to date, especially if applied from TAIWAN.

What is the processing time to get a Family Permit (6 months) VISA currently?

I have read somewhere that the EU impose a 10 working days max processing period, is that true or no longer true?

I also read some cases where people have had to wait months.... How come? How can family be separated for so long...Are those cases exceptional?..

I can’t say more than this , I have waited more than 197 days almost 7 Months and I still waiting, I don’t know and no one know how thy works! Some people thy got the mails saying that (your application not straight forward and thy got the visa after 1 month some of thme 2 and many of them after 6 months some people thy got the answer after 7 months! Last month someone waited more than 188 working days to get his visa some people the waited more than 7 months finally thy got refused! No one know how thy work and why thy did that !!
I hope everyone who still waiting like me will get his fp as soon beacuse thats to hrad wait that long !!

EEA FP application for non EEA spouse’s minor daughter. We are already living and working in the UK, my wife has a Residence Card of a family member of EU citizen and now we applied for her daughter.

Application made from Manila, Philippines:
8/12: application made
8/12: application forwarded to Sheffield
2/01: (14 working days) decision made

Waiting for the documents to be sent back home.

Finally good news!!

My mom (from India) a Non-EEA national, dependent family member of a EEA national's spouse applied for the EEA family permit on 21st Aug-2017 from Hyderabad.

Application timelines:

1. Submit the application: 21st Aug 2017
2. Two Emails (Not straight forward email) received from Sheffield in Sep-17 & Oct-17
3. No escalation emails
4. SMS received on 21st Dec 2017, "Visa dispatched from Chennai visa office)
5. Passport with Visa, received on 23rd Dec 2017.

Hi ... i have applied from Kolkata , India on 14th june 2017.... and still waiting after 142 working days.... I have applied through a lawyer in Mumbai.... My wife is EU national and working in UK for almost 5 years.... I got not straight forward message on 28th of june .... Spoke to MP through email twice but nothing happened .... how can we escalate ?

Hello everyone! I just wanted to share with you that I got my FP today!!! I applied from Madrid on 5th Dec and I received an email on 29th Dec informing that my application was assessed and they will send my documents back by curier as I previously paid for this service.

So I just wanna say, don’t lose the hope. If you submitted all documents that support your case, you should get it 100%.

I wish you all can get an answer as soon as possible!
