Tier 1 general ILR eligibility after 2015

Hi all

request your help in clarifying doubt about ILR eligibility

My first Tier 1 general visa was from Sep 2010 to Sep 2012 (2yrs)
Then got extended from Sep 2012 to Sep 2015 (3 yrs)

I am eligible for applying ILR in mid Aug 2015.[I have stayed continuously in UK.Number of absence days is below 180. Total absence in the past 4 yrs is 106 days taken at different times.]


As per new rule there wont be any extensions after April 2015. can i wait till Aug 2015 and directly apply for ILR or Should i get an extension before April 2015?

Your current T1G extension would expire in Sept 2015 and you are eligible for ILR in August 2015.

Apologies, but why do you still want to apply for an extension before April 2015 instead of applying for ILR in August 2015?

If you send your ILR application in 08/2015 and it reaches the home office any time before your current visa expires (of course not more than 28 days before your current visa expires) then you should be fine even if your current visa expires while you are waiting for the decision on your ILR application.

I am bit worried and confused about no of days allowed to be out of UK.I still have more than a year for applying ILR.

Initial Tier 1 Visa :1 Sep 2010 to 1Sep 2012 (2 yrs)
Entry into UK: 3 Oct 2010 (after 33 days)
Visa extension: 1Sep 2012 to 1 Sep 2015 (3yrs)

No of days out of UK:[including initial 33 days]

YearNO to_date from_date Total days
Year 5 01-Sep-15 01-Sep-14 yet to take
Year 4 30-Sep-14 01-Sep-13 29
Year 3 30-Sep-13 01-Sep-12 21
Year 2 30-Sep-12 01-Sep-11 30
Year 1 30-Sep-11 01-Sep-10 59


Total no of days out of UK is 139 days as of now.How many days can i be out of UK till i apply ILR? If there are shortage of days, i might not have any option for extension after april 2015 to fill up gaps.

Please advice.

It is no more than 180 days allowed in any of the 5th, 4th, 3rd or 2nd year. In every year, you have way below 180 days leave and unless you are going to take 180 days leave in your last (5th) year, you need not to worry.

Here is the guidance and its on page 19.

However, its worth noting that rules change frequently and you will be applying for ILR according to the rules current at that time. It would be safe to apply for an extension before 04/2015 but I am just thinking that it might just be an overkill!

Also note that you should be calculating the years backwards from your date of ILR application which you are saying would be 08/15

Hi,

In your reply you mention of "it is no more than 180 days allowed in any of the 5th, 4th, 3rd or 2nd year", What about the 1st year ?

It may seem weird but i may be few of those who is trying to complete 5 years in UK before April 2018 ( Deadline). While I'm in the threshold of not over 180 days for year 5,4,3 and 2 when it comes to year 1,I'm unable to meet this condition.
