Tax-Free Childcare

Hello
I understand that Tax-Free Childcare is only eligible for when both parents are working, which applies in our case.
However, I'm a UK citizen but my wife is a non EU citizen (with no recourse to public funds).
Is it a requirement that both working parents must be free of immigration control to apply, or would it be possible if I apply under my name as I'm a UK citizen?
