Tier 1 Entrepreneur ILR - Job Table Filling Query

Hello all,

In couple of weeks time, I am going for my ILR application through T1 E 5 year route (Initial application Pre -April 2014). I have question regarding job creation and filling job table. The scenario is as follows,

Employee A: Worked 11 months of Full-Time and 13 months of Part-Time.
Employee B: Worked 7 months of Full-Time.
Employee C: Worked 2 months of Full-Time.

All the employees have different job title.

Altogether 20 months of Full-Time and 13 months of Part-Time.
I have read in other threads that Pre-April 2014, we can combine above jobs to fulfill job creation requirement for ILR. My questions is, what is the best way to present above jobs in the application form?

Scenario 1
-------------
Employee A (11 months FT) + Employee C (2 months FT) = 13 months FT
Employee b (7 months FT) + Employee a (13 months PT) = 13 months FT (assuming 13 months PT = 6 months FT)

Can I do that? Please advise.

Two options:

1) Option 1
Job 1 : Employee A
Job 2: Employee B
Job 3: Employee C

2) Option 2
Job 1: Employee A FT for 11 months
Job 2: Employee A PT for 6 months (combined with Job 3)
Job 3: Employee A PT for remaining 7 months (combined with Job 2)
Job 4: Employee B
Job 5: Employee C
For Job 1, 2, 3, use slightly different titles - For example, Cashier 1, Cashier 2, Cashier 3

I think either one works for the transitional arrangement, but I prefer Option 2 as it meets the following requirement set out in the immigration rules:

If jobs are being combined, with two part time employees being used to create the equivalent of one full time job, the employees being relied upon must be clearly identified by you in your application.

Yes, you're right, it is best to go with Option 2.

does job titles have to be same as FPS?

Small confusion, as rule says,

"2 part-time jobs can be combined to add up to 30 hours a week or more and form the equivalent of one full-time job, as long as the 2 part-time jobs exist for 12 months."

But that is not the case here. PT exists only for 13 months. Is it still fine?

No, job titles don’t have to be same on FPS.

The 12 month requirement is not applicable to you as you are pre 2014

It will help me and clear my confusion. I think it's fine split continuous PT job into two to make it simple and easy to see.

I read in some other thread that, you can't claim hours if you are applying before the pay date.

For example, if someone wants to apply on Jan 26 and an it's also pay day for the company as it's last Friday of the month. We still can claim hours for Jan?

Yes, you can. The date does not matter. I think I applied around 10th of the month and claimed employment of that whole month. Run your payroll, submit the FPS to HMRC and so you can include those documents. Actual pay date to the employee or HMRC does not change and does not matter.

Today I have received my documents and BRP of my ILR application.
