Application British Nationality for my son born abroad

Hello,

I am applying for my sons british nationality. I am british by descent (born in Spain) my father is born british . I received my passport when I was born, I dont have a Spanish nationality.

I am completing the MN1 from Spain, my son is currently 2 months old, also born here in Spain.

I lived in britain from 2000 until 2007. The section I am applying under is section 3(2).

- Can anybody help me with the questions 1.27. Date father became settled in the UK

would this be when my passport was issued?

- Do I have to complete the biometric enrolment?

- And finally, I am not sure what fee to send?

I think the application is not by registration or naturalisation. But I am not sure..

If I am reading it correct, its 973 pounds.

From other peoples posts, could I apply him as a "stateless person" I asked here briefly and they said he needs to be British. Seems this wouldn't be cheaper...

Your child is not stateless. He is Spanish by birth. This is so regardless of whether you have applied for a DNI and passport for him in Spain.

Yes, you can apply on the basis of section 3(2). But not on the basis that he is stateless because he is not. He will be a dual citizen but please note be will only be British by descent and not able to pass British citizenship to his children of born outside the UK.

Could he pass on if he live a minimum of 3 years there.. like I did? The difference being that my father was british by birth and his father by descent...

Section 3(2)
To qualify under this section, the parent who is British by descent must have been
born to a parent who was a British citizen otherwise than by descent (or if that
person died, then they would have been a British citizen otherwise than by descent
but for their death).
Only chance s 3(5) but different requirements.

Just to ensure that our advice is accurate, can you list where & when you, your British parents(s) & any British grandparents(s) were born? That will help us understand who is British citizen by descent and who is British citizen otherwise than by descent.

Thanks for the help guys,

My father was born in Cardiff (1940), married to my mother (German).

My grandparents on my fathers side, all born in UK.

So my son would need to have his children born in the UK , for them to have british nationality..?

I have to send this application asap, just to confirm is the fee correct?

Yes, if his children are claiming British citizenship by descent via father. However, they may also have a claim via their mother.
