One parent on ILR, Other Illegal, Child born Abroad on ILR

Hi,

My wife and kids hold ILR, they born in Pakistan,

my question is can children apply for citizenship , if one parent have no legal status in country .

They have separate immigration history not linked with me.

Hi Malik,

Please ask precise questions.

"My wife and kids hold ILR" is that 1) your wife, 2) your kids or 3) your wife and your kids?
"they born in Pakistan" is that 1) your wife, 2) your kids or 3) your wife and your kids?

Were your kids born before or after your wife gained ILR status?
Where are your wife and kids living?

Children born abroad would have the same immigration status as that of the less-privileged parent, unless they are born after one parent has naturalised.

For children born abroad to register as British citizens, they are expected to hold ILR, with at least one parent either being a British citizen or applying to be one AND the other parent holding ILR.

HI, giramondo

My wife and 2 kids live in UK, all born in Pakistan, they live in the UK on Tier 1, and granted ILR,

i have adverse immigration history, i have never applied spouse visa,

My question is:

Can my kids apply for naturalization,( one parent is on ILR and other have no Status) As "secret.simon" mention in his reply

How was the children granted settlement if you are in the UK without a status.

For registration under Section 3(1) to be successful, the Secretary of State will need to be satisfied in the long to medium time the father of these children will not be removed from the UK or removable from the UK.


Your status will be necessary in that regards.

Hi,

My wife and i have children custody settlement contract before she left to UK.... I have transfer/ given all my parental responsibility rights to my wife with consent.

so she applied for initial application, further leave to remain and ILR as sole responsible parent.

i never applied applied as her spouse etc, i had adverse immigration history in UK.

so my question is that, can my children having ILR apply MN1 ( Child Registration) solely on their own , as Mother dont want to apply citizenship due to Driving Point / Credit history / lone etc.
