TIER 1(G) DEPENDENT 10 DAYS SHORT AND 5 YEARS ELIGIBILITY TO APPLY ILR

I was on Tier 1 General and got an ILR in Jan 2017 and would like to check with you for my wife's eligibility to apply for ILR.

Tier1 General dependent visa issued: 6th March 2013
Entered into UK: 7th May 2013
Tier 1 General dependent extension applied in June 2015 and got the visa validity till 26th Jan 2018.

Query1: Eligibility to apply for an ILR?

Hence she entered into UK on 7th May 2013 ( with in 3 months from the visa issued date 6th March 2013), Could we consider the visa issued date 6th March 2013 to calculate the 5 years period? If so then 5th March 2018 will be the date to reach 5 years.

If 5th March 2018 is the date to reach 5 years then Could we apply for ILR 28 days before to 5th March 2018 which will be 6th Feb 2018?

Query 2: Tier 1 general dependent visa validity 26th Jan 2018 and 6th Feb 2018 is the eligibility to apply for ILR. What could I do to save more than £1500 and apply SET (O) application for ILR? Could I apply FLR (HO) through post on 25th Jan 2018 and then vary it to SET (O) on 6th Feb 2018?? Would Home office refund the application fee of FLR(HO) application and take the application fee only to SET (O)?

Dear Vinny,

Thanks for the swift response which is very useful.

Is there any changes in ILR rules recently for Tier 1 General dependents? Considering the "visa issued date" instead of "UK Entry date" to calculate 5 years period for ILR, if applicant travels with in the 3 months of visa issued date. I think, earlier this rule is only applicable for the Tier1 General main applicant and not for the Tier1 General dependents. Please confirm.

If eligibility to apply for ILR is 6th Feb 2018, Shall we submit postal/online application for Tier 1 general dependent extension on 23rd Jan 2018 and then vary it to SET (O) on 6th Feb 2018?

Would Home office refund the application fee of Tier 1 general dependent extension and take the application fee only to SET (O)?

Thanks a lot for the prompt replies.

If eligibility to apply for ILR is 6th Feb 2018, What would be the better option to save the money and apply SET (O) application on 6th Feb 2018 through premium service? Shall we submit postal/online application for Tier 1 general dependent extension on 23rd Jan 2018 and then vary it to SET (O) on 6th Feb 2018? Is there any better approach other than this?

Would you suggest to upgrade to premium on/after 6th Feb 2018 once the ILR eligibility date reaches? Please confirm.

SET (O) application by registerd Post: 25th Jan 2018 which may reach on 29th Jan 2018
Fee Payment: Check (5 days to clear) around 2nd Feb 2018
Upgrade to Premium: May receive the confirmation from Home office after the ILR eligibility date which is 6th Feb 2018.

Hi,

There's a 10days gap between the ILR eligibility date to Tier1 depedent visa valid date.

Visa Validity: 26th Jan 2018.
ILR Eligibility: 6th Feb 2018.

If I send the SET (O) application by register post on 25th Jan 2018 (before the Eligibility date 6th Feb 2018),

Would be there any chance home office may reject my application during the Upgrade?
What would happen if i dont go for upgrade?

Dear Immigration boards forum,

Apologies for the rush and Would you please help me with the below query?

There's a 10days gap between the ILR eligibility date to Tier1 dependent visa valid date.

Visa Validity: 26th Jan 2018.
ILR Eligibility: 6th Feb 2018.

If I send the SET (O) application by register post on 25th Jan 2018 (before the Eligibility date 6th Feb 2018),

Would be there any chance home office may reject my application during the Upgrade?
Would it be safe to apply for pbs dependent extension through post then vary to set (0) on/after 6th Feb 2018? (premium service)
Will the home office consider pbs dependent extension application submission date (25th Jan 2018) and check the validity to consider the set(0) application?

Option 1 is safest, but more complicated with subsequent varying. Probably unnecessary, due to the short time involved to qualify.

To be safer still,
Option 1: vary to ILR after completing qualifying period.
Option 2: upgrade to premium service after completing qualifying period.

Option 1: vary to ILR after completing qualifying period worked for me without any issues.

PBS Denpendent extension application sent in Post to Home office: 22/01/2018.
Cheque Payment Processed: 28/01/2018
Bio-metric letter received: 02/02/2018

Vary from PBS Dependent to SET(O).
Set(O) Application Premium Service @ Sheffield: 07/02/2018
ILR Approved: 07/02/2018.

PBS Dependent extension application fee refund: 28 days.
