Child Benefit and Child Tax Credit - FLR (M)

Dear Immigration Gurus,

Please I need your help and guidance in relation to claiming Government Funded Child Benefit (30 hours free childcare benefit), Tax Free Childcare and Child Tax Credits.

I am currently on Further Leave to Remain (FLR) - M visa with No recourse to public fund and I am earning 20K + annually and my spouse is on Indefinite Leave to Remain (ILR). We are going to get British Passport for our 2 years old soon via MN1 section 1(3) route. My questions are:

1) Are we able to claim 30 hours free childcare benefit our child when she turns 3?
2) Are we able to claim Tax Free Childcare?
3) Are we able to claim Child Tax Credits?

You can claim tax credits in JOINT names with your spouse on FLR(M). A person on ILR is entitled to claim.

30 hours child care has a requirement that neither parent can be on the 'no recourse to public fund' restriction, so you likely won't qualiy for this one.

Hi all

I understand 30 hrs is not public fund.

Does this mean if my partner with ILR applies and get it. Would it affect me because I understand my NI details is required in the form.

I have FLR.
