Which Form should be used for Tier 1 (G) Dependent

Hi,

I was on HSMP visa but now got my ILR, I did not apply my wife ILR with my application, her visa is till valid till Aug 2018. Now I wanna submit her application, can anyone guide me which form should be used for her application Set(o) or Set(M)...?

Please suggest or share your experience related to this application... Many Thanks

On what basis did you apply for ILR, 10 years long residence or Tier 1 General?

How long has your spouse been in the UK on a PBS Dependent visa?

It is Set(O) for PBS dependents.

Hi,

I applied on HSMP (Tier -1 Genera) basis and MY wife came on 01 April 2011. Secondly, she apply in Jan for ILR but can we travel aboard before apply..?

If your wife arrived in April 2011 as a PBS Dependent, she could have applied for ILR already as only needed 2 years residence.

What is her full immigration history including visa start and end dates and where she applied (in the UK or out of the UK)?

She can travel before ILR without any issues.

Hi,
When I was PSW (Post study Work Visa) she came as my dependent on 01 April 2011, on April 2011 I applied for HSMP and she was my dependent, we got visa till 04 July 2013, than we applied for extension and the Home Office made its decision on 15 Aug 2015 and gave extension till 15 Aug 2018, in the meanwhile I got my ILR but she did not pass her life in uk test that's why she could not apply with me, now she has passed so now we will apply on 13 Jan because that's the earliest date she got for premium service.

Sounds good. I was trying to establish if there was any chance she might have applied for a visa from outside the UK as that would have reset her clock for ILR.

UK Tier 1 (G) Dependent needs maintenance..?

Hi,

I got my ILR through HSMP, my wife is living with me since 03 April 2011 as a dependant, Now I am going to apply ILR for her. I just wonder do I need to maintain my bank statement? if yes how much I have to keep in my account?
Secondly, Please check documents list and let me know if I need any further document
  • Set M Form
  • Passport
  • BRP Card
  • Life in UK Test
  • NERIC Certificate for English
  • 2 X Photographs of her and 1 my Photograph
  • Marriage Certificat
  • My Passport and BRP card (ILR)

Your wife is the MAIN applicant on Set(O) and it is her details not your details.
The following statement is written on the Set (M) form "Application for indefinite leave to remain
in the UK as the partner of a person or parent of a child present and settled in the UK and a biometric
immigration document "
And as I told you I already got my ILR that's why I choose that form
She does NOT hold a spouse of BC/ILR visa to qualify on Set(M). It has everything to do with the visa category she holds only.

There is no maintenance fund for ILR on Set(O).

I am not sure if you need proof of income to satisfy HO you can maintain yourselves.
