10 years broken?

Post by Kamil15 » Mon Feb 19, 2018 2:41 pm

Hi everyone,
I come to uk on student visa in 2011
Which expired in mid 2012 I extended in same category and it expired in nov 2014.
Full timeline below
Granted in 2011 till july 2012(tier 4)
Granted in nov 2012 till nov 2014 (tier 4)
Got married and applied for spouse in August2014 to vary my leaves.
Got refusal in March 2015 and accused of cheating in toiec test and HO also said that my previous leaves was curtailed and sent notice which i never received.
I lodged apeal and went to FT in agust2015 i won on both grounds and judge found me innocent and lawful in uk as i never received any curtailed and nor the HO proved in court.
HO appealed the decision and we went to upper tribunal july 2016 after a week the decision was set aside and was referred back to FT for rehearing.
November 2016 went back to hearing and again judge found me innocent of deception and lawful in this country and was enjoying section 3c,
The presenting officer agreed witn judge in hearing that my leave was not lawfully curtailed a
As they don’t have any copy of notice to prove it.
Anyways my appeal was allowed on human right ground and was granted 2 and half year visa with
Letter stated that i have to make 3 more applications to go toward ILR.
My question is my 10 years chain broke or is That
Clock is still continues?
My current visa expires in july 2020
And my 10 years will complete in feb 2021.

You guys advice will be greatly appreciated.
Many thanks

Kamil

It is NOT necessary to bump your post/topic after only 20 minutes.

When someone is available online and can work out what you have written and provide a response, I am sure they will.

IS96 does break a person's lawful residence. One need to establish if the IS96 was indeed lawful, if it was, then it has the potential of breaking your long residence.

Thank you very much obie, it wasn’t lawful as the judge said in his judgment that i was lawful and was having section 3c leaves during that time, when HO appealed that decision the senior judge turn it down and refused permission to go to upper tribunal after that they granted leave to remain and said that i have to complete 120 months to go towards settlement. Obie As you can see above my full history what you think please?
Many thanks Obie
