Form SET (M) ILR - Just a few quick questions pls!

Post by a1d » Wed Mar 21, 2018 1:13 pm

Hey all!

Hope someone can help with the following questions pleaseee!

Date of first entry to UK: 09/08/13 (wife of BC)
5 years in the UK completed: 09/08/18

a: Is it correct I can book my PSC appointment from 12/07/18 (28 days before the 5 years are up?)

b: I am working and meet the £18,600 financial requirement (so does my British spouse) but does he have to support the application with his employment details too or can it be done solely on my employment and payslips etc? Does it "look" better to immigration officers if we're both working or does that kind of subjectivity not factor into it since the rules are met?

c: If granted ILR in August and I get my BRP etc., can I proceed to apply for naturalisation using the JCAP service straight away? (have been out of the UK a total of 268 days from August 2015)

d: Cost of ILR and Naturalisation application (and life in UK test): £2389 + £610 + £1330 + £50 = £4379. Is there any other cost I'm forgetting?

Thank you so much for reading!

Appreciate your all your help!

A

Yes, you can apply at any point within 28 days before reaching 5 years residence.
b: I am working and meet the £18,600 financial requirement (so does my British spouse) but does he have to support the application with his employment details too or can it be done solely on my employment and payslips etc? Your income alone is fine. You need to meet the requirements either jointly or on your own. There is no 'will it look better' to it.

Yes, provide you meet all the requirements for 3 years spouse of BC application, including being physically present on the exact same corresponding date at the start of the 3 year period, to the date you submit your application.
d: Cost of ILR and Naturalisation application (and life in UK test): £2389 + £610 + £1330 + £50 = £4379. Is there any other cost I'm forgetting?

Cost for British passport?
You don't state your nationality, but you also need to meet the English requirement for both ILR and Citizenship.

Thanks for replying back so quickly!!

Yes cost of passport - forgot that one! I'm from Chile and have completed an IELTS test which is valid for two years if I'm not mistaken? I think I might be ready on that front!

Also, I just checked and I was away in August 2015 for a short while but was physically present on 15/08/15. So this means I can't submit the application for naturalisation until 15/08/18? Do you know roughly how long these applications take?

And finally, if I use the JCAP service with NDRS, I can keep hold of my passport right?

Once again, thanks for all your help!!

Is it level B1 and from a provider on the current HO approved list?

You can apply as spouse of BC as soon as you get your ILR BRP card. If you apply online and use NDRS, they are currently taken 1 to 2 months at present.

Yes.
