Cooling Period

Hi

I've worked in UK for an year May-2016 to May-2017 on Tier 2 ICT from an employer A.

Now I've got an offer from UK employer and they are doing my Tier 2 General (hopefully I get RCoS next week and will apply for VISA)

Now my sceptical mind have a doubt whether I fall in cooling period thing to wait till May,2018 or can straight away apply in Feb-2018?

Experts kindly clarify

yes got it Vinny, thank you.

Although my VISA expiry was 17 May 2017, I returned on 30 Apr, 2017 ( I have proof of ticket, immi stamp - date of arrival on passport etc.)

Without knowing this, my employer applied for CoS this month - so say if it is stamped on 15 Feb-2018, as CoS is valid for 3 months (perhaps - 17 May 2018)

Will I be OK to apply on 1 May 2018 (given the timelines for VISA processing is 10-15 working days)??

Experts please confirm this or otherwise??

12 month cooling off period starts from the date you LEFT the UK, not visa expiry date.

Thank you CR001. I left on 30 Apr, 2017. So I am eligible to apply on 1 May 2018

now my CoS is expected to be approved between 12 Feb 2018 and 17 Feb 2018 (whenever Home Office start allocation this month), and say if it is on 15 Feb 2018 and CoS is valid for 3 months, am I allowed to apply for VISA on 1 May 2018 (general processing times for T2 VISAs is 10 to 15 days)

Will I be ok?

or Alhtought my CoS i approved on 15 Feb 2018, can my sponsor wait for some more time before they assign the CoS to me

I've posted this question as part of a big question on other topic. Thought I'd better to ask it separately

1. If RCoS is approved next week by UKBA, can my Sponsor choose to assign it to me after a month?
2. In that case, RCoS validity (3 months), starts ticking on Assign date or Approval date?

Please help me to understand

Thanks a lot Sv2018, so If my CoS is allocated next week by HO...I believe my sponsor choose to assign after 15 days or so, and from the date of assignment I can utilise it within next 3 months

I am trying to understand this, as I am in cooling period till 30 Apr 2018, so the maximum CoS validity time I can get by late assignment the better I will be with my VISA application post 30 Apr 2018

Cooling period proof

Hi

Please help me with following questions?
  • I was in UK on Tier2 ICT Short Term valid from 18-May-2016 till 17-May-2017, however I returned from UK on 1-May-2017 itself, please confirm my Cooling ends on 1-May-2018?
  • I have a airticket webcopy (I lost my boarding card) I have a immigration stamp on passport confirming my arrival on 1-May-2017. I hope these are good enough as proof?
  • And can I apply for Tier 2 General on 2-May-2018?
  • I have a valid Business Visitor VISA valid till 1-Nov-2019, I hope this doesn't make me invalid for applying Tier2 General on 2-May-2018?

Evidence

Hi - Please confirm, whether I can submit any one of them or all of them as cooling period end evidence?

Below is the guidance rule I copied from T2 Policy document....

Where you left the UK before your last period of Tier 2 leave expired, the 12-month period can start earlier than the date your leave expired but only if you can provide evidence
of you having not been in the UK for a period immediately prior to that date. Acceptable evidence may include, but is not limited, to:
  • a) travel tickets or boarding card stubs, but only if you or your previous sponsor also
    submitted an SMS report at the time, confirming that your employment in the UK had ended;
    Tier 2 Policy Guidance (Version 01/2018) Page 23
    b) exit or entry stamps in your passport which confirm that you were not in the UK;
    c) a letter from the your overseas employer confirming the date you started work overseas, after returning from the UK;
    d) any other evidence that shows you were not in the UK.

Where evidence is produced and accepted, we will calculate the cooling off period to start from the earliest date supported by that evidence. In all cases where the Certificate of Sponsorship was assigned for longer than 3 months, the cooling off period will apply, even in cases where your length of stay in the UK is less than 3 months. For instance, where you were assigned a Certificate of Sponsorship of 6 months in length and we were notified that you ceased working in the UK after 2 months, the cooling-off period will apply as the Certificate of Sponsorship was assigned for more than 3 months.

The guidance says it all. Have as much as documents which will make this evident, you can provide to prove.

But I would suggest to wait for your official leave End date for calculation purpose and then apply.
why are you in a hurry as it appears, it's just a matter if few days between you UK leaving date and leave end day ?
I have no answer to your second question.

Thank you Sv2018, it is just 2.5 weeks difference, however there is a contention with date of joining and some other processes followed by VISA approval. Hence I am thinking how safely to apply to cover those days

Hi Team

On my CoS,

1. Work start date is mentioned is wrong, but on Sponsor note it is corrected. Is this fine?

2. Also, my Salary too mentioned wrong and corrected on Sponsor note. Is this fine?

3. My sponsor gave me copy a of CoS, in a word doc (it is not screenshot from their SMS) where UK Visas n
Migration Logo is not there. My question is, do I need to submit CoS document as proof or just CoS
reference Number
is enough?

Kindly clarify?
