Permanent residence vs residence Card

I'm EEA citizen, my spouse non EEA, his residence card will expire soon so we want to apply for PR. I do have some gaps in my employment in past 5 years. Solicitor suggested that I may not qualify for PR. Question: if PR will be refused will immigration issue 5 residence card instead? Or we will need to apply again?
