Wife ILR (SET-M) Advice needed

Wife ILR (SET-M) Advice needed

I am thinking about applying for my wife ILR end of next month as her leave is valid until end of August (5-year route, Spouse of person settled in UK). She will be applying on form SET-M.

In the new form I came across this question and I am not sure how to answer this one:

Q2.9: Could you and your partner live together outside the UK if necessary?

What is the purpose of this question? why is home office interested to find out if we can live outside UK?
We have a 1-year old son who was born here and I am British Citizen myself so why would we move outside UK?

You can answer no, due to family and economical ties to the UK.

Are you aware that you can apply no earlier than 28 days before your wife completes 5 year of residency in the UK :?:

Yes I am aware about that as well. In fact I have already verified it on this forum here:

My wife came to UK as a dependent of a person settled in UK (I was on ILR) on 16-06-2013. Her Entry Clearance visa was granted outside the country dated from 23-5-2013 to 23-02-2016.
On 02-02-2016 we went to Solihull PEO and she was granted further leave expiring 23-08-2018.//

Think she can apply after 26-05-2018.

What date did your wife first enter the UK on her spouse visa?
(Casa, not CR001)

It seems to me that according to the above that you do not have to answer 2.9

Hi Casa, it was in my post :)
She entered UK on 16-06-2013. So I think we can apply within 28 days which infact will be anytime after 19-05?

I am filling it online and in there you don't get exact all the questions which are in SET(M).
Based on what we have answered they skip certain questions which makes me wonder why did I get that question as I mentioned we live together for last many years.

I did not realize they now have an online version for SET(M). I hope they still have the paper version available when we apply next year.
