British Citizenship Application - Recently got ILR

Post by zindagi03 » Thu May 24, 2018 10:33 pm

Hi
i read the CITIZENSHIP FAQ'S commmon question, and in Q#2 it is stated that if main applicant became BC after spending 5 years in UK, then his/her spouse automatically became spouse of BC disregard the visa category he/ she have previously. so then He/she can apply BC after spendig 3 yrs in uk not 5 years . This thread was last updated in 05 may 2016. so i want to know that still this rule is applicable?
and please post the link for that rule.
many thanks in advance.

The spouse of a BC does still need to have either ILR or PR status as well, which generally takes a minimum of five years anyway.

So, what that rule now means in effect is that the spouse of a BC can apply immediatly after gettling either ILR or a DCPR and not have to wait for a further year. The naturalisation absence requirements for the spouse of a BC are calculated over three years rather than five years.

Split into a separate topic as not directly related to the original OP's questions.

Many thanks for guidance.
I got ILR last week on the basis of PBS dependent visa after 5 years, as my wife already became British citizen in 2017 by Tier1 General category.
My main concern is that i have more than 500 absences from 2013 til 2016. But from feb 2016
I spent only 252 days outside UK
So can i apply British citizenship under the rule of (section 6(2) of the British Nationality Act 1981) by spending only 3 years in UK, on behalf of my wife?.

Thank you very much in advance for your help.

Regards,
Masood

Yes you can if you have not spent more than 270 days in the last 3 years and 90 days in the past 12 months outside the UK before applying.

Yes, either passport or naturalization certificate plus marriage certificate. If you apply through council, you keep your original documents.

British Citizenship - Joint application possible

Post by zindagi03 » Tue Nov 27, 2018 1:43 pm

Hi ALL,

I received my ILR on the 20-05-2018 under British citizen spouse category.
Now I want to apply Naturalization and passport application both same time. But according to Sopra representative I can’t apply passport application at the time of online naturalization.

So my question is , Is there any other way I can apply for both?

Thank you for your time.

No there is not at this time.

Had you applied when you asked originally in May/June, you would have been able to obviously.
