Moderators, Fellow members who already done court hearing, is it common that the home office did not send their appeal bundle within the deadline given by court?on the notice of hearing I received,home office should submit their docs to court and to us by 12th july. Its already due but we didnt receive any docs from HO. Any info regarding this will be highly appreciated. Thanks
Hi mister123 when is your hearing my hearin was on July 12th and home office sent their bundle 3 days before the hearing and it was basically the refused letter my solicitors received the first time, so I know they have certain days but on my experience I wa a really worried cause I didn’t want to adjourn under no circumstance but it did arrive to my solicitor like I said on Thursday and my hearing was the following Tuesday !!

Thanks for you reply Amelia, my hearing date will be on 23 October. Im worried as well as it may be adjourn coz they didnt send their bundle on the deadline date given by the court. When you recieve for notice of hearing from ftt did they mentioned as well that the home office should send their bundle to you and to the court with specific deadline? If they send that 3 days before your hearing it sounds like they just ignored the deadline given to them by the court.

Yes mister123 a deadline was mentioned but they ignored it and sent it 3 days before the hearing, so i wouldn’t worry too much!! Why did they refuse you ?

applied 30/03/2017 on flp (fp) father of a british

i was refused on 5th june 2017 but given in country appeal

appeal filled and waiting for hearing date notification

now i have an emergency and need to travel

Does anyone know if i can appeal to have my passport so as to travel and see my daughter who had a terrible accident

will traveling cancel my appeal ?

whats the timeline for getting an appeal hearing date ?

I was refused in November 2017 and my hearing was in July but I’ve read recent posts of people with hearings as soon as 3 months. I’m not sure if they can give you your passport back and still have an appeal but there again let’s see if one of the moderators can answer that one, hope your daughter gets better soon!!

Seems like copy paste refusal letter that I can go home and apply for entry clearance visa there. Anyways, thanks again Amelia for your reply. Atleast now I wont be worrying too much as based on your case they send their bundle 3 days before the hearing.

In my case my application was refused May. In country appeal and was lodged same month. Received notice of hearing 12th June and Court hearing is scheduled on October.

Seek help to your solicitor if you have one. Hope your daughter may get well soon.

Good evening everyone, I am a new member and I have issues that I need advice. Please ladies and gentlemen can someone please help? I applied for LEAVE TO REMAIN DISCRESIONARY. Did biometric on the 11/05/2018. I applied through a solicitor using my child and my British unmarried partner. I have not had anything and the solicitor said he can’t not contact the home office until after 12 weeks from the date I did the biometric. I came on a visit visa, I studied here in the uk. My return ticket passed yesterday and the visa will expere on the 11/07/2028. Is there anything I can do in this case?? Please somebody help. I want to know also, what happen if me and my partner slit up before the application is granted, would that affect anything? Also if my application is granted and we by any chance slit will I need to inform the home office? Am asking all these questions because my partner keep throwing me out without no just cause. She sleep out every time without me saying anything, if I complain she will ask me to leave. I have never been this unhappy in my whole life before. As I am talking now, she went out since 10am and not back yet(22:49) and I am not expecting her till 03:00 Monday morning.
Someone please help me out. I don’t know if am posting this in the right forum, if not somebody help me reshare it or please someone let me know am in the right forum.

SO SO HAPPY FOR YOU! In country appeals always tend to get the best judgement. Unfortunately for my husand's case, no right of appeal was given so under JR :( Pray that we get something soon from the UTT

Congratulations to everyone who are finally enjoying there peace of mind after long struggle with HO and for those of us who are still waiting and keeping hope alive let's be strong and continue hoping for the best .

Does any1 have any idea how long it can take if caseworker rings u n tell u reason 4 delay of your application and says he is working on my application will get letters my solicitor sent them from the department that handles letters tgen once he has them he will finalise my application. The case worker rang m yesterday morning it's 10 months since l applied n l applied as a single parent to British child then my solicitor varied it in January to partner route in January though case worker was saying all he as is single parent route but from the system he sees my partner passport was sent back to me so he wanted to know if am applying via partner n if so did my partner sign declaration form. I told him we did all that n my solicitor got reply from them when he sent the new forms of variation to partner route together with passort so the mistake should be from there side cz l did update them on the change in circumstances.
He said he will chase up those letters that my solicitor has ever sent them n finalise my application.
This I think is cz l contacted my MP the 3rd time n they need to reply my MP by end of this month .Am going through hell on earth with a very unsuporting husband so mp contacted HO again on the 2nd of this month.
Does any1 hv any idea,l was shocked on receiving the phone call until l couldn't ask the case worker questions.

Things are really bad for me am sure you know my story how l am in an abusive relationship.On Saturday l had to call 999 cz my husband was beating m until am bleeding.
The situation isn't easy he now thinks am after the house.He is tired of waiting 4 my visa n has confessed he married m thinking l will help with financial issues but he is tired of waiting.
I hv a swollen jaw,face n red eye l lied to police cz didn't want to expose domestic abuse.
But now am just feeding my baby breakfast then am living to go to c the MP n seek help even if it means living in refuge centre it's ok m n the baby will hv to survive it's better than staying here.
I talked to a neighbour yesterday n she adviced m l live n go to refuge centre she saw all my bruises n she knows what l undergo here.
Am like a slave in this house :cry:

We have our hearing coming up in 2 weeks and to be honest i'm really scared for some reason haha.
I've never been to a court and don't know what to expect.
