application for LTR taking too long

Post by rogerroger » Sun Mar 06, 2005 6:50 pm

Hi
My friend, a doctor applied for "leave to remain" through post, it has been 12 weeks and the home office says it is still processing his application.
Do you guys/gals think it is advisable for him to withdraw his postal application and apply in person(since that takes one day to process).

He has already started working at his hospital but he needs his passport in order for his family to apply for a visa, besides his passport is expiring in 6 months and he needs to renew that too.

In what capacity is this leave - some FLR applications can only be submitted by post.

Rogerroger, he had a valid visa? He then applied for an extension before that visa ran out? He has yet to hear if his application has been successful?

If yes to all of those questions, he currently has a valid visa! The reason? Section 3C! This treats the old visa as continuing even though its expiry date has passed. He is not an overstayer. The terms and conditions of that old visa still apply. Accordingly if the old visa allowed him to work, he is still allowed to work at the present time.

yes, he had a valid visa when he applied. but it has been 12 weeks and he was wondering if he could speed up the process by withdrawing his application and applying in person?

All FLR IED applications are postal - sorry he just has to be patient and wait his turn. He can request for expedited treatment on compelling grounds as listed by the Home Office - IMHO those presented do not meet the criteria but then again I am not the caseworker in question.

this person(another doctor) actually goes to the home office when he has to get an FLR(doctors have to gt a new FLR with a new contract which usually lasts for 6 months)
