naturalisation for non EEA holding permanent residence

Post by carlosandres-coral44 » Sat Aug 04, 2018 10:23 pm

I have been Granted with permanent residence under EEA law, as I was married for 5 years to an EEA national,...
So my question is do I still rely on the EEA national (my spouse) in order to keep my permanent residence? or it just relies on my own person since i was granted with the permanent residence,?????

another question is:
when I get to apply for the naturalisation, will I need to provide any sort of information reelevant to if I am still married to the EEA national,or if we are still together; or that wont matter anymore??

thanks for your help

It's all about you now. You don't rely on anyone else for anything now. One year after PR, you can apply for naturalisation with your docs, and no other docs from your ex.

Naturalisation For non EEA holding (PR)

Post by carlosandres-coral44 » Sun Aug 05, 2018 9:36 am

Hey guys

my question is:
After holding permanent residence for 1 year:
what documents do I need to provide?
is it for 6 Years in total, 5 years before permanent residence and then 1 year from permanent residence?
what sort of documents do I need to provide? how many per year?
how long does it take to get the naturalisation
and any advice that can matter in this case...
thanks a lot

I believe the same set of docs used when went for your PR - the docs that pertains to you.
Add the one year docs after the PR too
The 6 years HMRC docs
If you've been in the UK for more than that 6 yrs, then docs that proofs legal residence before your marriage. If you were not legally resident before your marriage, then I'm afraid there may be hiccup as they look for 10 years of lawful residence(Good character) - that's provided you have been resident that long.

I have never been ilegal in the UK, came as a student and then got married, but not even 1 day have been ilegal,...
-Arrive as a student september 2012
-Got married to an EEA national march 2013
-And got permanent residence march 2018

so certainly I qualify for naturalisation in march 2019

so I guess documents covering all the 5 years from 2013-2018
plus documents covering the one year under permanent residence from march 2018 to march 2019

Yep. If you can get docs from that Sept 2012 too, hopefully, you would be fine

So what is that thing about the one year of holding permanent residence,?
cause what i was told and informed is that you need 5 years of legal residence, and then 1 year of holding permanent residence which means 6 years in total?
bit confused now... lol
my 5 years of legal residence would be from marriage march 2013 to march 2018(as a family member); and then one year of holding permanent residence march 2018 to march 2019, then ready for naturalisation, well the only fact is that march 2019 either way i will be ready for naturalisation.. lol...
but dont wanna mess up with the documents ill have to send for the qualifying period.

You're looking at the requirements the wrong way round.

The requirements count backwards from the date of application for naturalisation.

You need
a) to have held settled status (ILR/PR) in the UK for at least one year preceding the date of application.
b) to meet the respective absence requirements over one and five years preceding the date of application
c) to have physically been in the UK at the start of the five years preceding the date of application
d) to not have breached immigration laws for 10 years preceding the date of application

I really wonder since when the permanent residence period start counting?
does it start counting since the issue date of the biometric card? or does it start counting from the date that is written in the letter received from the Home office?
is so confusing??????

when they say that you must have held settled status (ILR/PR) in the UK for at least one year preceding the date of application.,---- this the most confusing part for me, do they mean the date written in the Biometric card(issue date) or the Date Home office Granted you with the (ILR/PR)?????
cause you know they write a Date in the letter where they say since when your permanent status is confirmed, and something different is the issue date of the Biometric Card?
so which is the one that applies?

and that is literally driving me crazy?
does anyone know??

As has already been stated, it is the date of PR in the LETTER for EU citizens and their family on the EEA route.

ILR is issued under the UK immigration rules and not relevant to your circumstances.
